29-158-Order Recorded 10/4/1978VOL 29 PAcE 158 IN THE BOARD OF COUNTY COMMISSIONERS IN THE STATE OF OREGON FOR THE COUNTY OF DESCHUTES In the Matter of File No. Z-78-33 Zone Change Request by Donald Walker, from A-1, Exclusive Agriculture to R-1 Single Family Residential and M-1, Light Industrial 0 R D E R This matter coming before the Board of County Commissioners upon the Hearings Officer's recommendations, who held a public hearing on this issue, August 8, 1978, and recommended approval, And it further appearing to the Board upon reviewing the Hearings Officer record in the matter that the following findings of fact were established: 1. This site lies within the Phase II area for sewer service and that it is not known when sewers will be available. Consequently, the minimum lot size is 14,000 square feet, and the accompanying Preliminary subdivision Plat #456, Gemstone Estates, is consistent and in conformance there- with. 2. The residential land use policies and objectives of the Bend Area General Plan are in compliance with the proposed residential use of the property. 3. In the matter of the zone change to M-1, Light Industrial, this proposal is likewise consistent with the Bend Area Comprehensive Plan in that it is so situated that its develop- ment would be in furtherance to the area already industrially zoned, the State Highway Maintenance Yard being directly across the street from the proposed property. Pursuant to the plan the new industrial development is encouraged where community services can be provided. The proposed site will be served by City water and has good access by O.B. Riley Road, which is an arterial on the Comprehensive Plan. As indicated above, the property is within Phase II Sewage Plan and as located on the Land Use Plan would be the logical extension of urban services and existing industrial zoning. 4. It is the finding of the Hearings Officer that zoning of this property will help implement Comprehensive Plan policy of diversifying the industrial base by providing a wider range of opportunities for light but non-polluting industries. The Hearings Officer further finds that the applicant satisfactorily addressed himself by his written presentation and documents elaborating and expanding therein to the applicable Statewide Goals and that the application for both the R-1 and M-1 zones is in compliance with our County ordinances. The County deeming this action to be in the public interest, IT IS HEREBY ORDERED that the zoning of the following described property be changed from A-1 to R-1 and M-1 as shown on the attached map: South side of Archie Briggs Road between the Deschutes River and O.B. Riley Road, portion of Section 20, T17S, R12E, approx. 8.14 acres.
