29-314-Order Recorded 11/1/1978VOL 29 PACE 314 F IN THE BOARD OF COUNTY COMMISSIONERS IN THE STATE OF OREGON FOR THE COUNTY OF DESCHUTES In the Matter of File No. Z-78-53 Zone Change Request by Ralph DeMarco & Frank Gilchrist to change the zone from M-1 Light Industrial to C-2, General Commercial 0 R D E R This matter coming before the Board of County Commissioners upon the Hearings officer's recommendations, who held a public hearing on this issue, October 5, 1978, and recommended approval, And it further appearing to the Board in reviewing the Hearings Officer record in the matter that the following findings of fact were established: 1. The property, consisting of approx. 17 acres, is designated by the Bend Area General Plan as either highway commercial or general industrial; the Bend Area Plan recognizes commercial developments along major highways, but recommends these developments be in "centers" rather than strips along the highway. The Hearings Officer finds this rezoning to be a logical extension of the highway frontage and will provide to the highest degree possible the implementation of this area as either highway commercial or general industrial. He further finds that this property will be in all probability annexed into the City of Bend, with full urban services and of necessity meet the Oregon State Highway requirements for access. 2. As for the existence of a public need for a shopping center of this magnitude, applicant by a voluminous record has sufficiently documented the existence of such a need and furthermore, has established the unavailability of property of the intended zone requested, C-2, for a site of the size and magnitude comtemplated. 3. The Hearings Officer further finds that those Statewide Planning Goals which are applicable to the property have been satisfactorily addressed and complied with. The County deeming this action to be in the public interest, IT IS HEREBY ORDERED that the zoning of the following described property be changed from M-1 to C-2, as shown on the attached map: Near City Limits on the East side of Hwy. 97 across from the Bend Riverhouse, or more specifically described as tax lot 400, T17S, R12E, Section 29, tax lot 500, T17S, R12E, Section 28 and tax lot 1700, T17S, R12E, Section 21. 29 PAGE 315 s Page 2.
