29-867-Resolution Recorded 3/6/1979t 29W%`7 IN THE BOARD OF COUNTY COMMISSIONERS OF THE STATE OF OREGON FOR DESCHUTES COUNTY In the Matter of ) R E S O L U T I O N CITY OF REDMOND, ) AIRPORT INDUSTRIAL PARK PROJECT ) WHEREAS, the Economic Development Administration (EDA) regulations require that the City of Redmond must have legal title to all lands included within the Airport Industrial Project during the construction period; and WHEREAS, this includes legal title to the rights-of-way for the proposed arterial road which extends East from.South Highway 97 and Wickiup Avenue to and through the industrial park to connect with Sisters Avenue on the North; NOW, THEREFORE, IT IS HEREBY RESOLVED that the Deschutes County Board of Commissioners hereby conveys the rights-of-way, as described below, to the City of Redmond for the duration of the construction period for the City of Redmond, Airport Industrial Park Project: An easement through a portion of the North Half of Section 28, the South- east Quarter of Section 21, and the West Half of Section 22, Township 15 South, Range 13 East, Willamette Meridian, Deschutes County, Oregon, lying 60 feet on each side of the following -described centerline: Beginning at a 3" brass cap marking the Northeast corner of said Section 21; thence South 680 07' 54" East a distance of 818.41 feet to the "True Point of Beginning" for this center- line description; thence South 150 31' 01" East 1,222.26 feet; thence following along the arc of a 1,100.00 foot radius curve right through a central angle of 150 22' 18" an arc distance of 295.11 feet; thence South 000 08' 43" East 1,088.62 feet; thence along the arc of a 1,100.00 foot radius curve right through a central angle of 540 12' 12" an arc distance of 1,040.63 feet; thence South 540 03' 28" West a distance of 826.37 feet to the East line of said Section 21; thence con- tinuing South 540 03' 28" West 1,588.59 feet; thence along the arc of a 1,100.00 foot radius curve right through a central angle of 350 24' 32" an arc distance of 679.80 feet, crossing the South line of said Section 21 at an arc distance of 314.81 feet; thence South 890 28' 00" West 1,107.16 feet; thence along the arc of a 800.00 foot radius curve left through a central angle of 310 05' 31" an arc distance of 434.13 feet; thence South 580 22' 29" West 522.18 feet; thence along the arc of a 453.81 foot radius curve right through a central angle of 660 56' 05" an arc distance of 530.16 feet; thence North 540 41' 26" West 821.21 feet to the terminus of this centerline (from said point of terminus the Southwest corner of said Section 21 bears North 880 48' 01" West a distance of 232.56 feet). Implicit within this Resolution is an agreement on the part of the City of Redmond to transfer all or part of the completed arterial road and the rights-of-way therefor to Deschutes County, based upon a subsequent determination of the City of Redmond and Deschutes County responsibilities for maintenance of the constructed arterial road. A hearing to hear objections to said exchange shall be held in the Deschutes County Courthouse Annex, Conference Room "A," on Wednesday, March 21, 1979, at 10:00 a.m. DATED this day of March, 1979.
