30-62-Order Recorded 3/21/1979• ` VOL 30 Pact 62 IN THE BOARD OF COUNTY COMMISSIONERS OF THE STATE OF OREGON FOR DESCHUTES COUNTY In the Matter of ) MINOR LAND PARTITION ) O R D E R 78-202 ) (ORS 203.127) This matter came before the Board of County Commissioners on March 21, 1979, upon the oral report of TERRENCE B. O'SULLIVAN, ESQ., who reported that a nuisance exists at 19351 Pinehurst Road, Bend, Oregon. The nuisance exists in that the minor land partition MP78-202 was approved by this Board in violation of Section 3.220 of County Zoning Ordinance PL-5. Said Section provides that the minimum lot size in the area covered by MP78-202 is five acres. The lots created by said partition are of an area less than five acres. Section 12.020 of County Zoning Ordinance PL-5 provides that if land is used or proposed to be used in violation of Ordinance PL-5, the proposed use constitutes a nuisance and the County may institute appropriate proceedings to prevent the unlawful use. It having been confirmed by the Planning Director that the said partition was granted in error, and good cause appearing therefor: IT IS HEREBY ORDERED that Notice pursuant to ORS 203.127 be served upon HOWARD DIETZEL, 64979 Highway 20, Bend, Oregon, setting a hearing on the existence of a nuisance for April 4, 1979, at 10:00 a.m., or ten (10) days after service of the Notice, whichever is later.
