30-133-Order Recorded 4/4/1979At R V VOL 30 PAGE 133 IN THE BOARD OF COUNTY COMMISSIONERS IN THE STATE OF OREGON FOR THE COUNTY OF DESCHUTES In the Matter of File No. Z-78-67 and PA-78-12 Zone Change Request by IFM & Associates from RR-1, Rural Recreation Residential to PD, Planned Development and request for Exception to LCDC Goal #4, Forest Lands O R D E R This matter coming before the County Board of Commissioners upon the Hearings Officer's recommendations, who held a public hearing on this issue, January 9, 1979, and recommended approval-, And it further appearing to the Board upon reviewing the Hearings Officer record in the matter that the following findings of fact were established: 1. The Hearings officer takes judicial notice that the Master Plan for Indian Ford was one of five Master Plans designated in the Deschutes County Comprehensive Plan of 1971, as being within a private forest management and recreation residential area and as such, could be better utilized when developed as planned communities. Also, exceptions to the Comprehensive Plan apply to such a development by virtue of authority, expressed or implied, given to the developer by the governing body of the County, particularly if the need arose in the future for additional contiguous property to be developed, with the spirit and intent of the following: (a) Policy #5 concerning resource management and conservation states: "The County should recognize the full potential of lands capable of recreational subdivision development through the application of reasonable design and improvement standards which will: assure proper access to all lot owners, encourage good design in relation to natural and scenic amenities, avoid adverse effects on adjacent private or public lands, related lot area to physical requirements for adequate sewage disposal and water supply, assure lot owners of reasonable access to natural waterways and prevent impairment of water quality". The zone change sought is consistent with this development policy. The design and improvement standards to be applied will avoid any adverse effects on adjacent private or public lands, will relate the lot areas to the physical requirements for sewage VOL 30 PACE 134 Page 2 File No. Z-78-67 and PA-78-12 disposal and water supply, and the natural and scenic amenities in the area will be preserved. 2. That there is existence of a public need for the proposal has been met by the voluminous self-serving declarations of the real estate profession, together with the written briefs submitted by the applicant's representatives. 3. The recommendation set forth in a letter by Mr. Lorin Morgan, Planning Director, Sisters City Planning Commission, that the County Planning Department initiate a Planned Development classification in its newly revised Comprehensive Plan for all of the Indian Ford areas. And it further appearing to the Board that these facts support the proposed zone change and plan amendment, and The County deeming this action to be in the public interest, IT IS HEREBY ORDERED that the Comprehensive Plan Map be changed from Extensive Agriculture to Planned Development and the zoning of the following described property be changed from RR-1 to PD per attached: Easterly off Camp Polk Road approximately one mile North of Sisters, or more specifically tax lots 202, 703RI, and 600 in Section 33, T14S, R10E, or approximately 60 acres. Done by the order of the Board of Commissioners this 4th day of April, 1979, to become effective immediately.
