This matter coming before the County Board of Commissioners,
which the Planning Commission heard on the matter
at a public hearing on September 27, 1978 and approved
and which an appeal was filed and was heard by the
Board of Commissioners on November 30, 1978, and which
they approved and adopted the staff's findings of fact
in addition to their findings of fact:
STAFF FINDINGS:
1. The Bend Area General Plan designates the site within a
Development Alternative area to be developed to urban
standard residential densities as community facilities
become available. An urban medium density designation
would allow 2,000 to 6,000 square feet per unit if sewer
and water service were available.
2. This proposal at this location would not appear to con-
flict with any of the Statewide Planning Goals. The site
is undeveloped with juniper and is considered Class VII
soils or scabland. It is also within the Bend Urban Growth
Boundary and the applicant will propose that the site be
annexed into the City of Bend.
3. The Comprehensive Plan allows for "a greater amount of
area for duplexes or garden apartments and a greater
concentration of population in apartment developments in
selected locations than is permitted at present".
4. The subject property is within the Bend Urban Growth
Boundary and will receive water and sewer service when the property
is annexed into the City of Bend.
BOARD OF COMMISSIONERS FINDINGS:
1. The appeal was based on increase in traffic.
2. The developers states their plans call for approximately
250 units to be built on the subject 35 acres of land.
3. From 200 to 300 units can now be built upon this 35 acres
of land with the present zoning, thus making traffic a moot
question.

tingent on the applicant's agreement that no more than 250 single-
family living units be allowed on this 35 acres of land.
And it further appearing to the Board that these facts support
the proposed zone change and plan amendment, and
The County deeming this action to be in the public interest,
IT IS HEREBY ORDERED that the Comprehensive Plan Map be changed from
Development Alternative, Single Family to Development Alternative, Medium
Density and the zoning be changed from R-1 to R-2 as shown on the attached
map:
Tax lots 100 and 103 in the NW4 of NW4 of Section
35, T17S, R12E, Southeast of the intersection of
Denser Road with Neff Road.
Done by the order of the Board of Commissioners this 4th
day of April, 1979, to become effective immediately.
