ORDINANCE PL -9 )
WHEREAS, Section 16.000 of County Procedural Ordinance PL -9 provides that
the ordinance may be amended by the Board of County Commissioners on a proposal
initiated by the Board; and
WHEREAS, there is an error in Section 13.000 in that the effect of subsection
(1) is that the Board may on its own initiative review decisions of the Hearings
Officer but not the decisions of the Planning Commission; since ORS 215.202 provides
that the governing body of a county may provide for the organization and operations
of a planning commission, the State statutory purpose is to make the county govern-
ing body responsible for the actions of the planning commission and it is incon-
sistent with the purpose of this statute that decisions of the Planning Commission
should not be subject to review,
NOW, THEREFORE, IT IS HEREBY RESOLVED:
1. On April 11 and 25, 1979, at regular open public meetings, the following
amendments to County Procedural Ordinance PL -9 shall be read pursuant to
ORS 203.045(3) (stricken words are in parentheses () and added words are underlined):
"Section 13.000. Review by Planning Commission and/or Board:
"1. A review of the Hearings Officer's actions and decisions may be
initiated individually or jointly by the Planning Commission or the Board.
A review of the Planning Commission actions and decisions may be
initiated by the Board.
"2. The review shall be ordered within fifteen days of the date of
the final written decision of the Hearings Officer (.), or the final
decision of the Planninq Commission.
"3. A review hearing shall be conducted in the same manner provided
for appeals (.) on the record."

2. The Board finds that an emergency exists adversely affecting the health,
safety and general welfare of the County, and accordingly, this Ordinance Amendment
shall be effective upon adoption, pursuant to ORS 203.045(9).
