BE IT REMEMBERED :
1. At a term of the Board of County Commissioners of Deschutes County, Oregon,
begun and held at the County Courthouse in Bend in said County on June 6, 1979, the
same being a term of said Board of County Commissioners sitting for the transaction
of County business, at which time the Board legally, by Resolution, proposed the
establishment of the above-mentioned road.
2. On the 6th day of June, 1979, the Board considered that a public necessity
existed for the establishment of said road hereinafter described, ordered that legal
notice be given, and appointed July 18, 1979, as the day of hearing on the establish-
ment of ALL OF SUNNYSIDE BOULEVARD.
3. At this time it appears to the Board that due notice of this intention and
this proceeding has been given, as by law required, for more than thirty (30) days
preceding the day named in said Resolution and said notice for a hearing hereon;
and this being after the date for hearing objections to such establishment, if any
there be, and there were none.
4. However, on July 12, 1979, the Board resolved to hold a hearing on
August 15, 1979, on the issue of whether to abandon public access to a one-foot
reserve strip as defined in County Ordinance PL-2, within Plat No. 394, Woodside Ranch,
Phase VI, until the Board establishes that portion of Sunnyside Boulevard shown on
the Bend Area General Plan adopted by County Ordinance PL-10 on July 11, 1979, which
connects the area shown on said plat with that portion shown on Plat No. 435,
Brightenwood Estates III. Said connecting portion is shown on the Bend Area General
Plan adopted by County Ordinance PL-10 and in the County Roadway Network Plan of 1978
and lies within Tax Lot 600, Section 21, Township 18 South, Range 12 East, Willamette
Meridian, Deschutes County, Oregon, as shown on County Assessor's Map 18 12 21.
As a result of the hearing pursuant to said Resolution, public access may be
temporarily abandoned to a proposed reserve strip as described below, and accordingly,
the Board finds that it would be in the public interest to defer establishment of
that portion of Sunnyside Boulevard within the proposed reserve strip until the
hearing now set for August 15, 1979.
5. Should the Board decide not to abandon public access to the proposed.reserve
strip, its intent would be to establish the strip as part of Sunnsyside Blvd.. However,
should public access to said proposed reserve strip be temporarily abandoned, the
Board intends further to defer establishment of that portion of Sunnyside Boulevard
within the proposed reserve strip until the said connecting portion of Sunnyside
Boulevard is established.

IT IS THEREFORE ORDERED AND DECREED that said road described below shall
be established as described in said Resolution and by Order herein as follows,
to wit:
A strip of land for street purposes, All of Sunnyside Boulevard,
Township 18, Range 12, Section 21, being .06 miles in length, and
80 feet in width, as platted on the official plat of Woodside Ranch,
Phase VI, as recorded in the office of the County Clerk, Deschutes
County, Oregon.
EXCEPTING THEREFROM the following-described property which it appears
may be established as a reserve strip pursuant to County Subdivision
Ordinance PL-2.
A reserve strip as defined in County Subdivision Ordinance PL-2 one foot
(1.00 ft.) by eighty feet (80 ft.), said land being a portion of the
Southwest one-quarter (SW%) of the Northwest one-quarter (NW'-4) of
Section 21, Township 18 South, Range 12 East of the Willamette Meridian,
Deschutes County, Oregon, said reserve strip being a portion of
Sunnyside Boulevard as shown on Woodside Ranch Phase VI, Plat Number
Three Hundred Ninety-Four (394) and described as follows:
Commencing at the West one-quarter (W%) corner of said Section 21, being
a 22 inch brass cap and the initial point of this description; thence
along the East-West centerline of said Section 21, North 890 28' 16"
East, 130.39 feet; thence around a 1560 foot radius curve left, 51.45 feet,
the long chord of which bears North 530 53' 58" East, 51.45 feet; thence
North 52° 57' 17" East, 291.81 feet to the true point of beginning.
Thence South 370 02' 43" East, 80.00 feet; thence along the arc of a
25 foot radius curve left, for a distance of 1.00 ft., the lonchord
of which bears South 51°48'34" West, 1.00 ft.; thence North 37002'43"
West for a distance of 80.02 feet; thence North 52° 57' 17" East for
a distance of 1.00 ft. to the true point of beginning.
IT IS FURTHER ORDERED that in respect to the above-described excepted portion of
Sunnyside Boulevard, the Board takes under advisement the decision on whether to
establish it as part of Sunnyside Boulevard until a decision is made on whether
to abandon public access thereto pending establishment of that portion of Sunnyside
Boulevard proposed in the Bend Area General Plan and the Deschutes County Roadway
Network Plan of 1978 running within Tax Lot 600, Section 21, Township 18 South,
Range 12 East, Willamette Meridian, Deschutes County, Oregon, Assessor's Map 18 12 21.
IT IS FURTHER ORDERED that the Deschutes County Surveyor shall file a plat
of said road, as surveyed on the ground, with the road records of Deschutes County,
showing the above-described proposed reserve strip as a public road not a part of
the County Road System.
