This matter came before the Board of County Commissioners on April 4, 1979,
on the Affidavit of ROBERT SWEENEY, attached hereto as Exhibit "A," and incorporated
herein by reference. IT APPEARING that said Affidavit establishes that a nuisance
exists in the unincorporated area of Deschutes County, to wit: The Northwest
corner of Alfalfa Market Road and Johnson Ranch Market Road, in Township 17 South,
Range 14 East of the Willamette Meridian, Section 22, Tax Lot 1000, owned by
WILLIAM A. SUTTON; and that said nuisance poses an immediate threat to the health
and safety of the people of Deschutes County, especially minor children attending
Alfalfa Grade School; and good cause appearing therefor,
IT IS HEREBY ORDERED that a Notice pursuant to ORS 203.127 be served upon
WILLIAM A. SUTTON, owner of record of the land on which the open cisterns are located
and upon which the dangerous solid waste is stored, apparently in violation of
County Ordinance CG-4. Said Notice shall state that a hearing shall be held on
the existence of the nuisance in Conference Room A of the Deschutes County Court-
house Annex, on June 4, 1979, at 10:00 a.m., or four weeks after service of the
Notice and Order, or the next County business day thereafter.

AFFIDAVIT
I, Robert Sweeney, first being duly sworn depose and say as
follows:
On April 26, 1979, in response to a complaint, I inspected
the property at the N.W. corner of Alfalfa Market Road and
Johnson Ranch Market Road (Township 17 S, Range 14 E, W.M.,
Section 22, Tax Lot 1000).
I found the following conditions:
1. The property is located 2 mile from Alfalfa Grade School.
2. The property had no fence to limit entry.
3. Sharp and/or rusty objects such as broken glass, stoves,
automobile parts, bicycle parts, wire and motorcycle
parts were strewn about.
4. Three cisterns were located on the property. Two
cisterns contained water. All three contained debris
and none had covers over their access holes. The largest
cistern was 7 feet deep with 5 feet of water. Another
cistern was 62 feet deep with 1 foot of water.
