31-394-Order Recorded 7/6/1979VOL 31 FACE 334 IN THE BOARD OF COUNTY COMMISSIONERS OF THE STATE OF OREGON FOR DESCHUTES COUNTY In the Matter of ) O R D E R COUNTY ORDINANCE PL-5 ) WHEREAS, 1. It appears that the A-1 Zone in County Ordinance PL-5 is not in complicance with ORS 215.243 setting forth the agricultural land-use policy of the State of Oregon; and 2. No agreements have been made with the City of Redmond and the City of Sisters pursuant to ORS 215.500; and 3. ORS 197.250 requires that all ordinances and regulations adopted by the County be in conformance with Statewide planning goals within one year of their approval by the Land Conservation and Development Commission (LCDC), and the zoning ordinances of Deschutes County have not yet been acknowledged by LCDC; and 4. ORS 197.175 requires that prior to acknowledgment by the LCDC of the County's Comprehensive Plan and Ordinances, the County must exercise its planning and zoning responsibilities in compliance with the Statewide planning goals adopted by the LCDC; NOW, THEREFORE, IT IS HEREBY ORDERED that all land-use applications, including zone changes, plan amendments, subdivisions, major and minor partitions, conditional uses, variances, mobile home placement permits and site plans, shall be analyzed by the Planning Director for compliance with the applicable Statewide planning goals, and written findings shall be made thereon prior to preliminary decision thereon until Deschutes County has a Comprehensive Plan and Zoning Ordinance acknowledged by the LCDC to be in compliance with Statewide planning goals. i DATED this 1.~! day of July, 1979. BOARD 0 C TY COMMI SIGN Chairman Commissioner Commissioner PAGE -1- ORDER t VOL 31 PAGE 395 M E M O R A N D U M TO: PLANNING DIRECTOR FROM: BOARD OF COUNTY COMMISSIONERS SUBJECT: ANALYSIS OF PARTITIONS AND SITE PLANS FOR COMPLIANCE WITH LCDC GOALS Pursuant to the Board's Order of July 6 , 1979, it is required that you analyze partitions and site plans for compliance with LCDC goals. Cogan and Associates have advised that all land-use applications should be analyzed for such compliance. In following this suggestion, the Board is interested in whether the Hearings Officer and Planning Commission have been analyzing the applications before them for compliance with these goals. Accyrdi=gly, we are directing you to supply the Board with copies of all written decisions of the Hearings Officer and Planning Commission, as well as copies of the minutes of their proceedings so that the Board may discharge its statutory responsibility to see that these proceedings comply with LCDC goals.
