Brightenwood Estates III and )
Woodside Ranch Phase VI. )
WHEREAS:
1. The Board of County Commissioners has approved Plat Number 435 of
Brightenwood Estates III and Plat Number 394 of Woodside Ranch Phase VI; and
2. These approvals violated Section 608 of Deschutes County Subdivision
Ordinance No. PL -2 and Section 1.F.1 of Deschutes County Standard Specifications
for Design and Construction (SSDC) in that no reserve strips as defined in
Section 109(0)(20) of County Subdivision Ordinance PL -2 were created at the points
where Sunnyside Boulevard exits the subdivision at a point at which the Boulevard
is stubbed off; and
3. Plat Number 435 of Brightenwood Estates_Ill,.filed in -.Book 17, Page 18,18-A,
on April 26, 1978, and Plat Number 394 of Woodside Ranch Phase VI, filed in Book
17, page 24, 24-A, on May 15, 1978, were recorded without the required reserve
strips; and
4. The Board finds that said strips are useless until that portion of pro-
posed Sunnyside Boulevard lying within Section 21, Township 18 South, Range 12 East,
Willamette Meridian, Deschutes County, Oregon is established as a County Road; and
5. The Board finds that the public will benefit from correction of the said
errors;
NOW, THEREFORE, BE IT RESOLVED THAT:
1. Pursuant to ORS 368.565 to 368.582, on the �Y day of ,
1979, at 10:00 a.m. in Conference Room A of the Deschutes County Cour ouse Annex,
Bend, Oregon, the Board of County Commissioners shall hold a hearing to consider
the abandonment of the right of public access to the below -described strips of
street until such time as a further right-of-way is acquired by the County and
established as a County Road across Tax Lot 600 of Section 21, Township 18 South,
Range 12 East, Willamette Meridian, Deschutes County, Oregon, and to establish said
areas as reserve strips pursuant to Section 109(C)(20) and Section 608 of Deschutes
County Subdivision Ordinance No. PL -2, and Section 1.F.1 of SSDC. Said reserve
strips are described as follows:

Within the Plat of Brightenwood Estates Phase III:
A reserve strip one foot (1.00 ft.) by ninety-nine point seven eight feet
(99.78 ft.), said land being a portion of the Southeast one-quarter (SVO
of the Northwest one-quarter (NW -4) of Section 21, Township 18 South,
Range 12 East of the Willamette Meridian, Deschutes County, Oregon. Said
reserve strip being a portion of Sunnyside Boulevard as shown on Brightenwood
Estates III, Plat Number Four Hundred Thirty -Five (435) and described as
follows:
Commencing at the North one-quarter (N14) corner of said Section 21, being
the initial point of this description; thence along the North-South
centerline of said Section 21, South 000 27' 16" West 719.71 feet; thence
South 450 00' 00" West, 1061.42 feet; thence around a 2040.00 foot radius
curve the length of arc being 313.77 feet and the long chord of which bears
South 490 24' 23" West 313.46 feet; thence South 530 48' 45" West, 402.38
feet to the true point of beginning; thence along the West line of the East
one half of the Northwest one-quarter of said Section Twenty-one (21) North
00 30' 25" East, 99.78 feet; thence North 530 48' 45" East for a distance
of one foot (1.00 ft.); thence South 00 30' 25" West, 99.78 feet; thence
South 530 48' 45" West for a distance of one foot (1.00 ft.) to the true
point of beginning.
The adjacent property owners are KIRK E. WARD, ROCKWOOD DEVELOPMENT COMPANY,
and ROBERT G. BUESCHER.
Within the Plat of Woodside Ranch Phase IV:
A reserve strip one foot (1.00 ft.) by eighty feet (80 ft.), said land being
a portion of the Southwest one-quarter (SW%) of the Northwest one-quarter
(NWS) of Section 21, Township 18 South, Range 12 East of the Willamette
Meridian, Deschutes County, Oregon, said reserve strip being a portion of
Sunnyside Boulevard as shown on Woodside Ranch Phase VI, Plat Number Three
Hundred Ninety -Four (394), and described as follows:
Commencing at the West one-quarter (W1-4) corner of said Section 21, being a
212 inch brass cap and the initial point of this description; thence along
the East-West centerline of said Section 21, North 890 28' 16" East, 130.39
feet; thence around a 1560 foot radius curve left, 51.45 feet, the long chord
of which bears North 530 53' 58" East, 51.45 feet; thence North 520 57' 17"
East, 291.81 feet to the true point of beginning; thence South 370 02' 43"
East, 80.00 feet; thence along the arc of a 25 -foot radius curve left for a
distance of 1.00 feet, the long chord of which bears South 510 48' 34" West,
1.00 feet; thence North 370 02' 43" West for a distance of 80.02 feet;
thence North 520 57' 17" East for a distance of 1.00 feet to the true point
of beginning.

2. Notice shall be given to all abutting landowners, and copies of this
Resolution shall be posted in accordance with ORS 368.575.
3. The Roadmaster shall examine the strips described above and prepare a
written report pursuant to ORS 368.570, to be filed with the County Clerk.
