Seventh Mountain County ) ORDER PRELIMINARY TO CON-
Service District ) STRUCTION WORK
6 The Board of County Commissioners of Deschutes County,
7 Oregon, sitting as the governing body of the Seventh Mountain
8 County Service District pursuant to ORS 451.485 finds that
9 the Seventh Mountain County Service District has been duly
10 formed, and that it is now desirable to proceed with con-
11 struction of a sewage system for the District.
12 NOW, THEREFORE, IT IS HEREBY ORDERED by the Board of
13 County Commissioners of Deschutes County, Oregon, acting as
14 the Governing Body of Seventh Mountain County Service District:
15 Section 1. The sewage system facilities described in
16 the attached Exhibit "A" shall be constructed immediately.
17 Once the facilities are constructed, the District shall
18 maintain and operate the facilities pursuant to Oregon
19 Revised Statutes Chapter 451. The District has caused
20 engineering plans to be prepared as on file in the District
21 office pursuant to ORS 451.440.
22 Section 2. Construction of the sewage system facil-
23 ities shall be financed by assessments imposed upon benefited
24 properties, including the issuance of improvement warrants
25 pursuant to ORS 287.502 to 287.510 and the issuance of
26 bancroft bonds pursuant to ORS 223.205 to 223.295.

1 Section 3. Funds for progress payments due during the
2 construction of the sewerage system facilities, as a public
3 improvement of the character described in ORS 223.205 and
4 223.387(1)(f), shall be obtained by the District by the
5 issuance of improvement warrants which shall constitute
6 general obligations of the District as authorized by ORS
7 451.530(1)(c) and ORS 287.502 to 287.510.
8 Section 4. The entire cost of construction of the
9 sewage system shall be apportioned among the owner of the
10 "core" area and the unit owners of the condominium units and
11 common areas known as the "Inn of the Seventh Mountain" with
12 each owner of property specially benefited being assessed a
13 fair proportionate share of the cost of the system. The
14 assessment district shall consist of that real property
15 located within the Seventh Mountain County Service District
16 known as the Inn of the Seventh Mountain.
17 Section 5. After the sewage system is constructed, the
18 District may impose connection charges on each owner, and
19 may impose service or user charges for the maintenance and
20 operation of the sewage system services provided to each
21 owner. In addition, if the district finds it desirable, it
22 may finance the construction, operation or maintenance of
23 the sewage system facilities for the Seventh Mountain County
24 Service District by one or any combination of the methods
25 provided in ORS 451.490.

1 Section 6. This order shall be subject to referendum
2 pursuant to ORS 451.487. If a petition is submitted within
3 sixty days of the date of this order signed by ten percent
4 (10%) of the voters resident within the Seventh Mountain
5 County Service District, an election shall be held as soon
6 as practicable as of the date the petition is filed. If no
7 petition is submitted within the sixty day period, no election
8 shall be held.
