32-174-Order Recorded 9/5/197932 PAU 174 IN THE BOARD OF COUNTY COMMISSIONERS OF THE STATE OF OREGON FOR DESCHUTES COUNTY In the Matter of Exchange ) of Certain Real Property With ) O R D E R Administrative School District No. 1 ) This matter came before the regular term of the Deschutes County Board of Commissioners on the t;'_n'day of 1979. The Board finds: 1. Pursuant to ORS 271.310, that certain real property of Deschutes County described below is not needed by the County for public use; 2. Pursuant to ORS 271.330, the same property would be used and continue to be used for a public purpose by Administrative School District #1, a political subdivision of the State of Oregon; 3. Administrative School District X61 agrees that should such property cease to be used for a public purpose, such property shall automatically revert to the County; 4. It is in the best interests of the public to exchange said County property for certain real property of Administrative School District #1, described below; 5. ORS 271.310 authorizes such exchange; 6. The property, plus cash, to be exchanged between the County and the Deschutes County Historical Society on one side, and Administrative School District #1 on the other, are of equal value; and 7. Good cause appears therefor; NOW, THEREFORE, IT IS HEREBY ORDERED that: 1. Deschutes County convey to Administrative School District #1 certain real properties situated in Deschutes County, Oregon, described as follows: Being a parcel of land located in the West one-half W12), Section Fourteen (14), Township Eighteen (18) South, Range Twelve (12) East, Willamette Meridian, Deschutes County, Oregon. Being more particularly described as follows: PAGE -1- ORDER vot 32 %175 Beginning at the Northwest corner to Section 14, Township 18 South, Range 12 East, Willamette Meridian, Deschutes County, Oregon, thence South 89° 35' 44" East, 30.00 feet along the North line of said Section 14; thence South 00° 49' 17" West, 1200.00 feet to the true point of beginning of this description; thence continuing South 00° 49' 17" West, 1446.00 feet to the East-West Mid-Section line of said Section 14; thence South 00° 25' 18" West, 277.00 feet; thence South 89° 03' 39" East, 922.59 feet; thence North 32° 25' 54" East, 539.78 feet to the Westerly right-of-way of Arnold Market Road; thence North 250 13' 06" West, 1409.85 feet along said right-of-way; thence North 890 19' 42" West, 588.52 feet to the true point of beginning. Containing 37.33 acres, more or less. Provided that: 1. Deschutes County Historical Society pays the Administrative School District #1 the sum of FIFTY THOUSAND AND N01100 DOLLARS ($50,000.00) on or before the time of said conveyance by the County; 2. In exchange for said conveyance, Administrative School District #1 shall concurrently convey to Deschutes County that certain real property situated in Deschutes County, Oregon, described as follows: All lots of Block 24, Park Addition to Bend, commonly known as Reid School; 3. Should such County property to be conveyed cease to be used for a public purpose by Administrative School District #1, such property shall revert to the County; 4. Any conveyance of the property described herein to Administrative School District #1 shall! reflect said possibility of reverter in the County. DATED this 5 day of ~~w.~ Plt• 1979.
