This matter coming before the Board of County Commissioners
upon the Hearings Officer's recommendations, who held a
public hearing on this issue, June 22, 1978, and recommended
approval,
And it further appearing to the Board upon reviewing the
Hearings Officer record in the matter that the following
findings of fact were established:
1. The Bend Area General Plan designates the site within
a Highway Commercial Area. In the past, both C-1 and C-2
zones have been allowed in these areas. The site has C-1
properties immediately around it, but C-2 zones are
located both North and South within a few hundred feet. The
proposed Urban Area Zoning Ordinance would zone this site
highway commercial and would allow the use outright.
2. The proposed zoning should not conflict with the purposes
of the Statewide Planning Goals.
3. The applicant has indicated that he is moving an existing
operation and not establishing a new use. The question of
public need would seem irrelevant.
And it further appearing to the Board that these facts support
the proposed zone change, and
The County deeming this action to be in the public interest,
IT IS HEREBY ORDERED that the zoning of the following
described property be changed from C-1 to C-2 as shxnm
on the attached map:
West side of Hwy. 97 approx. 150 feet North
of Hayes Ave., at the edge of Bend, tax lot 1000,
T18S, R12E, Section 5DD, approx. 1 acre.
