Chairman Young called the meeting to order at 10:00 a.m. First item on
the agenda was bid openings on the Alfalfa Bridge. Dave Hoerning opened
and read the bids as follows:
E.M. Waldron Constr. $ 18,821.00
Doug Coats Constr. 17,916.00
Gervais Constr. 23,484.00
Engineers Estimate 20,890.00
Doug Coats Construction was the apparent low bidder and after extensions are
checked, the official low bidder will be announced.
There was no discussion of Road Department or General Fund bills.
Next on the agenda was a resolution adopting amendments to road systems in
the Bend Area General Plan. Dave Hoerning explained that the City and
County Planning Commission had met several times during the past year to
arrive at the changes recommended which were the inclusion of Addison Street;
Murphy Road extension and realignment; realignment of N -S collector vicinity
of Yeoman Road as well as several road sections to be deleted. Chairman
Young asked if the approved changes showed on the map. Dave Hoerning said
yes. Commissioner Grubb questioned if they approved the recommended changes
now, would that stop work on other changes that needed to be made. The
County Commissioners feel the State Highway Bypass route should be deleted
from the map. Commissioner Montgomery moved they adopt the resolution but
include a cover letter stating they want the State Highway Bypass deleted
from the Bend Area General Plan. Commissioner Grubb seconded the motion.
Vote was unanimous.
Vacation of an Unnamed Road in Section 8, T18S, R12 E.W.M., Blakely Heights
was discussed next. Chairman Young read the resolution. Commissioner Grubb
moved they set April 5, 1978 as the public hearing on this street vacation.
Commissioner Montgomery seconded the motion. Vote was unanimous.
The Planning Department had six zone change requests to be considered by
the Commission. The first one was for Emil and John Howell from AR -1,
Exclusive Agriculture UBC to SR -1, Suburban Residential to subdivide
property. Commissioner Montgomery asked how close this property was to

the Redmond city limits? Greg Comstock said 4 mile. This zone change has
the approval of the Hearings Officer and is in conformance with the Deschutes
County Comprehensive Plan. Commissioner Montgomery moved they approve the
zone change for Emil and John Howell. Commissioner Grubb seconded the motion.
Vote was unanimous.
Second request was by LaMoine Brant from A-1, Exclusive Agricultural to
SR -1, Surburban Residential for property located on the West side of
Boyd Acres Road, approximately 500 feet North of Fred Meyers Road, North
of Bend. Commissioner Montgomery asked how many acres were involved? Greg
Comstock said approximately 11. Commissioner Montgomery asked if this was
the area which only two or three years ago the people were against anything
less than 5 acre lots and now they wantto subdivide this 11 acres into
smaller lots? Commissioner Grubb explained this area was at the start of
the area Bob questioned, not the area behind. Dave Hoerning said this
particular area already had been broken into smaller lots. Commissioner
Montgomery asked if there were any complaints on this matter. Greg Comstock
said no. He said if the zone change is approved they would probably file a
plot plan for z acre lots. Commissioner Montgomery said in the future this
whole area would probably develop into 2 acre lots which is exactly what the
property owners didn't want when that area started developing. Commissioner
Grubb moved they approve the zone change for LaMoine Brant. Commissioner
Montgomery seconded. Vote was unanimous
Hessel Tractor was the third request from A-1, Exclusive Agricultural to
M-1, Light Industrial for expansion of the present use. Greg Comstock
told the Commission that Hessel Tractor was working with the State Highway
for a frontage road. This zone change has the approval of the Hearings
Officer who held a public hearing December 6, 1977 on this matter. Comm-
issioner Grubb moved they approve the zone change request for Hessel
Tractor. Commissioner Montgomery seconded the motion. Vote was unanimous.
Fourth request was by Gerald Dorn from A-1, Exclusive Agricultural to A -S
Rural Service Center for property North of Deschutes Junction where there
is presently a motorcycle rack track. The zone change is for construction
of a storage building on the premises. This request was approved by the
Hearings Officer at a public hearing on December 6, 1977. Commissioner
Montgomery moved they approve the zone change for Gerald Dorn. Commissioner
Grubb seconded. Vote was unanimous.
Fifth request was by D.T. Merritt from R-1, Single Family Residential to
C-2, General Commercial for property on the South side of Highway 20
opposite Pilot Butte, East of Bend to establish an automobile repair
facility. This request has the approval of the Hearings Officer and
is consistent with the Deschutes County Comprehensive Plan and the Bend
Area General Plan. Commissioner Montgomery moved they approve the zone
change for D.T. Merritt. Commissioner Grubb seconded the motion. Vote
was unanimous.

Final zone change request was by Eugene Carsey from A-1, Exclusive
Agricultural to A -S, Rural Service Center to open a small grocery store
and a retail store at the intersection of Highway 97 and Deschutes Highway.
This action has the approval of the Hearings Officer and is consistent
with the Comprehensive Plan. Greg Comstock told the Commission the 2/3
acre area for the zone change is next to the road. There are approximately
30 acres in this area. Commissioner Montgomery asked why they did not re-
zone the entire 30 acres? Greg said A -S zoning covered many uses and the
applicant showed only limited use. Commissioner Grubb moved and Commissioner
Montgomery seconded they approve the zone change for Eugene Carsey. Vote
was unanimous.
Bill Monroe, Planning Director told the Commission that one of his Assistant
Planners, Larry Granger was resigning effective March 31, 1978 and he wanted
to start looking for a replacement. Mr. Monroe asked the Commission if he
could train a new man for a week or two before Larry left. They told him
yes. The new hire will start at $864, the same as Larry is making.
Pat Gisler took the floor and told the Commission that he had sold a lot
in Tall Pines 5th Addition and when the wife of the owner went after a
building permit she was told by county personnel that they could issue her
a permit but they may have to tear the house down if the litigation with
LCDC was lost by the county. Pat feels this was a slanderous remark.
Louis Selken, DA told Pat the county could not refuse to issue a building
permit to persons but that the county had an obligation to tell the people
the property was in litigation. Bill Monroe said his staff has been telling
people this. Commissioner Young feels its the county's duty to tell people
litigation is in process. It was decided the county personnel should tell
people the property was in litigation,not that the house might have to be
torn down.
There being no further business, meeting was recessed at 10:40 a.m.
