DESCHUTES COUNTY BOARD OF COMMISSIONERS
TUESDAY, JUNE 19 2004
Commissioners' Meeting Room - Administration Building

Present were Commissioners Dennis R. Luke and Tom DeWolf,- Commissioner
Michael M. Daly was out of the office. Also present were Susan Ross,
Commissioners' Office; Catherine Morrow and Tom Anderson, Community
Development; Mike Viegas, Risk Management; Mark Pilliod and Laurie Craghead,
Legal Counsel; and media representative Lily Raff of the Bulletin. No other citizens
were present.
The meeting opened at 1:35 p.m.
Discussion of a Deed to Elk Horn Development LLC (Pahlisch Homes)
regarding Newberry Neighborhood Property.
Laurie Craghead gave an overview of the documents and time frame involving
the transfer of property to Elk Horn Development. Some details need to be
worked out regarding who would be named on the deed and who will be
signing the promissory notes. These documents will also need to cover the
property to be used for a homeowners' association park, and the sewer and
water facilities.
LUKE: Move that close of escrow be extended up to thirty days, to give
Legal Counsel an opportunity to work out the details of the sale.
DEWOLF: Second.

2. Discussion of ADA Report.
Mike Viegas distributed copies of the ADA report and recommendations to the
Board. He pointed out that part of it addresses a settlement; the results of the
report were above average. The report itself was very extensive. He reminded
the group that any structure that is built or remodeled after 1982 requires full
ADA compliance; if the structure was built or remodeled prior to 1982, this
depends on the particular item.
Commissioner Luke pointed out that this was a voluntary review that included a
survey of the City of Bend's facilities. He asked that Mr. Viegas provide an
executive summary of the report, pointing out the most important items.
3. Update on Upcoming Moves.
Susan Ross indicated that the Watermaster's Office should be moved out of the
Deschutes Services Building so that the entire building will be available for a
potential renter. Originally Risk Management was to move into the building
that will be vacated by the Surveyor's move to the Road Department. The
Watermaster could be moved to the Surveyor's vacated space, which would
make moving Risk Management unnecessary. However, Risk Management
would like to relocate, as this would provide additional space for their needs
and would remove them from the area near the future child care center.
It was decided that this would be discussed further when Mike Maier returns
from vacation.
Regarding the empty office in the Board's area in the new building, discussions
have been taking place regarding moving Sue Brewster, the attorney for the
Sheriff, into that space. Ms. Brewster works on a part-time basis for the
Sheriff, and often does not have enough work to keep her busy. She could
handle some civil cases for the County, as well as contract review. She would
receive staff support from the Legal Counsel office.
Although Sheriff Stiles was against this at the beginning, he has agreed to the
change as long as his office's legal needs are properly addressed and the
associated costs will be fairly allocated. Ms. Brewster would like this change to
occur, as she wants to keep busy and also feels that she would benefit
professionally by being around other attorneys and types of legal work.

Commissioner Luke, Mike Maier, Mark Pilliod, Sue Brewster and Les Stiles
are to meet and work out the details.
Legal Counsel asked that Tammy Credicott's office be provided to Legal since
it is close to the other attorneys' offices; Commissioner Luke said "no" at this
time.
Being no further items discussed, the meeting adjourned at 2:45 p.m.
