Chairman Montgomery called the meeting to order at 10:00 a.m. Scheduled
first was the Commission's decision on the Clifford Rose Conditional Use
Appeal. Commissioner Grubb read from a prepared sheet the Commission's
proposed findings of fact. He said the burden of proof is upon the proponent
to prove the conditional use should be granted. The applicant must show the
use meets the criteria of the county zoning ordinance, namely:
1. The location, size, design and operating characteristics of the
proposed use are such that it will have minimal adverse impact
on the surrounding area.
2. That the site planning of the proposed use will, as far as
reasonably possible provide an aesthetically pleasing and
functional environment.
3. If the use is permitted outright in another zone, that there
is substantial reason for locating the use in an area where
it is only conditionally allowed, as opposed to the zone area
where it is permitted outright.
4. That the proposed use will be consistent with the purposes
of the Ordinance, the Comprehensive Plan, statewide goals,
and any other statutes, ordinance or policies that may be
applicable.
Commissioner Grubb continued:
1. Testimony at the hearing clearly revealed the proposed use would
have a major adverse impact on the proposed value, liveability,
and permissible development of the surrounding area. The area
is zoned A-1, and consists of residential homes. Testimony
indicated that excessive dust, noise and pollution would result
from the proposed use.

2. The proposed use would not provide aesthetically pleasing and
functional environment to the highest degree consistent with
nature of the use in the given setting in that the proposed
quarry or strip mine operation would create. The proposed
use would create a barren unsightly pit in an area of existing
single family homes.
3. The proposed use is not permitted outright in any zone. Some
pits and quarrys exist in Deschutes County which should be filled
before another strip mining project is commenced.
Commissioner Grubb moved the County Commission adopt the findings of fact
and deny the conditional use permit of Clifford Rose. Commissioner Young
seconded the motion. Vote was unanimous.
Scheduled for hearing next was the proposed land exchange'with Brooks Resources.
Dave Hoerning explained this land exchange was at Awbrey Butte and was being
done to keep properties owned by the County and Brooks on the same side of
the road. This is an equal trade both in size and dollar amount. Bill Smith,
Brooks Resources favors this trade. Chairman Montgomery read the order.
Commissioner Young moved they approve the land exchange. Commissioner Grubb
Seconded the motion. Vote was unanimous. Commissioner Grubb said we would
be getting an improved road to Awbrey Butte.
Next hearings were on the establishement of Woodhaven and Pinehaven Avenues
as county roads. These roads are in Reed Market East, Second Addition, Subdivision.
Chairman Montgomery called for testimony for or against said road establishments.
There was none. Dave Hoerning outlined these roads on a map. Commissioner
Grubb moved these roads be established as county roads.
Commissioner Young seconded the motion. Vote was unanimous.
There was no discussion on Road Department or General Fund bills.
Chairman Montgomery opened discussion on the Planning Commission by telling the
audience the Commission is made up of nine members from throughout the county.
These people receive nothing for their efforts. They are very dedicated.
However, some are very busy people and cannot attend all the meetings. It is
important they do attend all meetings. John Thom and John Partin from Redmond
have resigned because they cannot attend faithfully. Mr. Montgomery wants to
start looking for replacements. They must live in the Redmond area. Commissioner
Grubb feels the article in the Bulletin critizing the whole Planning Commission
was unjust. He continued that these people put in a great deal of time sitting
on the Planning Commission. If a member misses two unexcused meetings in a row,
they are out. Commissioner Young feels if these people volunteer to serve on
committees they should plan on attending all meetings. A letter will be sent
to John Thom and John Partin thanking them for the work they have done on the
Planning Commission.

Chairman Montgomery opened discussion on a zoning or code coordinator. He
turned the meeting over to Eugene Venn who gave his report. Mr. Venn said
at the present time land use violations are approached as criminal procedure.
The county would like to try to treat violations as an in house problem not
a criminal matter. District Attorney Louis Selken favors the Code Coordinator
approach. Chairman Montgomery read a sample job description which described
a coordinator as an assistant planner who would work under the direction of
the Planning Director. Commissioner Grubb favors hiring a code coordinator.
He feels this will speed up enforcement of violations. Commissioner Young also
favors hiring a code coordinator. Chairman Montgomery questioned where the funds
would come from to pay for this position. Bill Monroe, Planning Director said
he hopes to cooperate with the public, and let them know the Planning Department
wants to work with them solving whatever probelms they may have. Mr. Van Horn
asked the Commission what they were going to do with this person after he
finishes his job. Will he be another drag on the taxpayer? Mr. Monroe said
this position will be part time on an on-going basis. Chairman Montgomery said
the employee will be a permanent employee as long as violations exist. Mr.
Van Horn asked if the code coordinator will take away the right of a violator
to a court hearing? The Commission said absolutely no! Commissioner Grubb told
the audience that he has been asked several times lately why they hired an out
of state Planning Director. Mr. Monroe is an Oregonian, but he was working in
Montana before the County hired him. Commissioner Young said they interviewed
only one from Central Oregon and several from various parts of the state, before
choosing Mr. Monroe. The Commission set this matter aside until the January 4,
1978 Courtday.
Commissioner Grubb opened discussion on the purchase of a new computer for
Deschutes County that could handle the Assessor's office. He said a lot of
time and effort had been spent looking into just the right computer for the
county. The CMSI system has been determined the best system cost wise and
otherwise. Ray Bennett, again expressed that he favored the CMSI system.
Commissioner Grubb said the Budget Board budgeted $115,000.00 for a computer
system. They need an additional $80,000.00 more which would come from Revenue
Sharing. He favors a two year purchase. The present equipment could be phased
out in two to three years. Commissioner Grubb moved they purchase the CMSI
equipment over two years, this fiscal year and next fiscal year. Chairman
Montgomery asked Ross Brown if we could phase out in two years? Ross said
yes the Library would have need for this present system and the county could
sell the equipment to the Library when we are finished with it. He said used
computers are not worth much. Chairman Montgomery asked if the new equipment
would mean new personnel. Ross Brown answered that $75,000.00 of the purchase
price is for programming. Charles Plummer, Roadmaster asked if the Road
Department will have use of the new system. Chairman Montgomery said the
Road Department will be the No. 1 priority not the Assessor. Chairman Montgomery
seconded Commissioner Grubb's motion. Commissioner Young said this was long
overdue. Vote on the motion was unanimous.

Chairman Montgomery read an order renaming Blakely Road to Badger Road.
Commissioner Grubb noted the State took down the signs we had on Badger
Road because our records showed it as Blakely Road. This action is nec-
essary to update the records. Commissioner Young moved they change the
name of Blakely Road to Badger Road. Chairman Montgomery seconded the
motion. Vote was unanimous.
Last item on the agenda was the discussion on the need for an Agricultural
Advisory Committee. Chairman Montgomery asked Lorin Morgan if the Committee
had met yet? Lorin replied that they had had about five meetings and the
36 names on the candidate list are active members. Chairman Montgomery
moved that the Agricultural Advisory Committee report to the County
Commissioners in six months and if they are not working, reappoint the
committee. Commissioner Young seconded the motion. Vote was unaimous.
Chairman Montgomery read an order whereby several county employees were
eligible for service pins for years of service to Deschutes County. They
were: Donald Sholes, 30 years; Leland Landers, 25 years; Rosemary Patterson,
Marjorie Snider and Eugene Carsey, 10 years; Yvonne Katter, 15 years; Joan
Rotsolk, Louise Devenport, Buddene E. Painter, Edward Kirbs and Johanna
Stephen, 10 years; Ray Bennett, Joyce Genna, Charlie Locke, Abe Young, Dave
Hoerning, Walter LeFor, Ed Norgaard, Lynette Meier, Jan Hildreth and Linda
Worlein, 5 years. Commissioner Grubb moved that service pins be awarded
to the above employees. Chairman Montgomery seconded the motion. Vote was
unanimous.
Chairman Montgomery announced that the Commissioners will meet on December
27, 1977 at 10:00 a.m. with local Fish and Wildlife officials.
Chairman Montgomery told the audience that the Forest Receipt money is in.
An estimated $501,000 will be divided between the three cities in the county.
Commissioner Young said the local Fish and Wildlife officials recommended
that the Fish and Wildlife Commission drop their suit against Deschutes
County. However, 1000 Friends of Oregon recommended to Fish and Wildlife
that they pursue the matter.
Chairman Montgomery wished the news media, namely KGRL and KBND, the Herwicks
and the Edwards and all the people who attend the Board of Commissioners
meetings regularly, Merry Christmas.
There being no further business or discussion, meeting was recessed at 11:20 a.m.
