Chairman Montgomery called the meeting to order at 10:00 a.m. First order of business
was bid openings. They were: Communications Bid for Sheriff's office. Bid packages
were given to RCA, GE and Motorola. Only Motorola responded with a bid of $42,550.00.
Bob asked if there was any reason why the other two did not bid. Chris Williams,
Search & Rescue said no, that the bid was put out in an equitable manner.

After all extensions are checked the successful bidders will be announced.
Scheduled next was continued hearing on the Annexation to Choctaw Village Sanitary
District. Mike Wilson, Engineer was present to answer any questions on this annex-
ation. Mr. Wilson said there would be no septic tank system or lagoon for holding
waste for the treatment plant. It will be piped directly to the pump station in a
sealed line. There will be no odors from this system. There were no objections
to annexation after all questions were answered. Dave Hoerning recommended the
Commissioners approve the annexation. Commissioner Young moved they approve the
annexation. Commissioner Grubb seconded the motion. Vote was unanimous.
Scheduled to be heard next were two annexations to Rural Fire Protection District No.
2; one off Stenkamp Road and one in Saddleback. There was no testimony either for or
against these annexations. Commissioner Grubb moved that November 15, 1977 be set
as the final hearing on these annexations. Commissioner Young seconded the motion.
Vote was unanimous.
The establishment of 17 roads into the county maintained system was next. Chairman
Montgomery called for testimony either for or against this action. There was none.
Commissioner Young moved that Doctors Drive, Franke Lane, Trap Court, Clay Pidgeon
Court, Sunglow Court, Sunset Place, Sunset Drive, Portion of 6th Street, 9th Street,
8th Street, 7th Street, 5th Street and Central Avenue in Hillman Plat, Brandis Court,
Cady Way, Lyman Place, Nels Anderson Road be established as county roads. Commissioner
Grubb seconded the motion. Vote was unanimous.
At this time the Commission presented a resolution for annexation of Tract No. 9,
Boyd Acres Road in T17S, R12E, Section 28 to Choctaw Village Sanitary District. Dave
pointed out this area on a map. Commissioner Young moved that November 15, 1977 be
set as the hearing on this matter. Commissioner Grubb seconded the motion. Vote was
unanimous.
Next to be heard was Ordinance No. PL -9, Providing for Uniform Procedure Governing Land
Use Applications, Public Hearings and Appeals thereon. Commissioner Grubb moved they
dispense with reading the 15 page ordinance except by title. Commissioner Young seconded
the motion. Vote was unanimous. The purpose of this ordinance is to govern the Hearings
Officer and take work load off the Planning Commission and Planning Department staff.
Commissioner Young moved they adopt Ordinance No. PL -9. Commissioner Grubb seconded
the motion. Vote was unanimous.
Chairman Montgomery opened discussion on harvesting bug infested timber on county owned
property. He feels the county should look into the possibility of harvesting this
timber before it dies and becomes firewood. He feels the county could make 10-15
thousand dollars doing this. It would cost the county about $200 to hire someone to
cruise the timber and determine where the timber to be harvested is. Commissioner
Grubb feels we could find $200 in the budget to do this. Money from the sale of

this timber would go into the general fund, Commissioner Young feels the county
should pursue this matter. Commissioner Grubb moved the county proceed with
harvesting bug infested timber on a re-occuring basis. Commissioner Young seconded
the motion. Vote was unanimous.
Commissioner Young told the audience the county was having a problem deciding who
runs the county; Fish and Wildlife, LCDC or the Commissioners. He wants to start
action to quash the Fish & Wildlife actions concerning subdivisions in Deschutes
County. He said he does not mind having a decision of his challenged, but he does
mind when he is not given the chance to make a decision and still have his authority
as a Deschutes County Commissioner questioned. Commissioner Grubb asked the DA if
they could file a motion to quash against the Fish & Wildlife. He said he has filed
all the necessary actions and asked Eugene Venn to clarify this matter as he brought
it up to the Commissioners. Mr. Venn said there are two or four more petitions to
be filed and his theory is to file a motion to quash on the new petitions. He realizes
its too late to file a motion to quash on previously filed petitions.
Commissioner Grubb told the audience that the county had received a letter from the
EDA rescinding their previous notice they were taking $144,000 of our contingency
fund on the new Justice Building. This means they will not be taking the money as
planned and using on another project.
Commissioner Grubb mentioned that at the public hearing on the Sunriver land sale held
October 18, a question was mentioned concerning whether or not a zone change request
through the Planning Commission was necessary before approving the land sale to the
Forest Service because the use of the land would change following the sale. Don asked
The District Attorney for an opinion on this. Louis said he would have an opinion with-
in a week. Chairman Montgomery said the Commission hopes to have a decision either for
or against the land sale in a week.
Commissioner Grubb said the Library had presented their proposed budget for the next
two fiscal years to the Commission. It will go before the votersin January, 1978.
Their budget reflects a 35% increase over two years. Chairman Montgomery feels their
35% increase is appauling. The county has stayed within the 6% limitation the last
three years, the Library could try to keep their budget down. The County Commission
has noting to do with the Library budget and they do not approve it.
Commissioner Grubb told the audience he is on the Winter Recreation Advisory Committee.
They had a meeting in Salem on October 13 and went over all the winter recreation areas
in the state. The areas that affect Deschutes County are the Cascade Lake Highway from
just above Inn of the 7th Mt.,Paulina East Lake road all the way up, on the Santiam
areas are from the road turning into Hoo Doo Ski Bowland the snowmobile parking lot.
Don said the fine for no parking permits will be ten dollars and if the county enforces
offenders we will get five dollars of the fine and five dollars will go intro a fund
for snow plowing. If the state levies the fines they will get the five dollars for
their general fund.
Chairman Montgomery told the audience that the state was holding a public hearing on
October 20 for testimony on their six year plan for this area. Commissioner Grubb
moved the county go on record as supporting four laning on the south city limits
of Bend and four laning the highway between Bend and Redmond. Commissioner Young
seconded the motion. Vote was unanimous. Dave Hoerning will read the County's stand
into the records at the meeting October 20 at City Hall.

Commissioner Grubb reminded everyone that the calendars show October 24 as a Veteran
Day Holiday, but that only Federal employees will observe this date. The County as
well as State offices will observe the traditional Veteran's Day which is November
11.
There being no further business or discussion, meeting was recessed at 10:55 a.m.
