Dave Hoerning opened and read the bids: Pape'Bros., Model #816, total bid $81,596.00; 5,000 mile or five year service, $15,791.00 and repurchase price of $58,748.00 making the total bid of $38,748.00. Pape' was the only bid offered and after extensions are checked the bid will be awarded. Chairman Montgomery opened the continued hearing on the vacation of a portion of 17th Street in Terrebonne. Arthur Kelley and Jan Paull spoke in favor of the vacation and Debbie Shuffield spoke in opposition to it. Commissioner Grubb said they had been to view the vacation and showed its location on a map. Chairman Montgomery questioned if this street was not vacated should'nt buildings on the right of way be taken down? Louis Selken explained that the owners of the buildings could never claim adverse possession because its public land. Dave Hoerning said the need to develop this road does not exist. Chairman Montgomery read the order. Commissioner Grubb moved that the vacation of 17th Street as petitioned be vacated. Commissioner Young seconded the motion. Vote was unanimous. Scheduled next was the public hearing on changing the name of Neff Road to Penn Ave. This matter was brought up because the City of Bend had asked the County to consider renaming Neff Road as an extension of Penn Avenue. All homeowners and property owners on Neff Road were notified. Chairman Montgomery asked for testimony in favor of this name change. There was none. Opposition: Mrs. Mathewson was against the name change. Mrs. Neil speaking for Sister Katheryn and herself said she thought the daytime meeting was unfair because many homeowners were unable to attend a day hearing. Mrs. Neil presented a petition signed by owners who could not be present. They all objected to changing the street name because they are rural and want the rural address. They also object to changing all correspondence. Sister Katheryn wants a year or two time element to give everyone a chance to make necessary changes. She also would like a medical name if Neff Road name is changed. Property owners in general objected to making Neff Road a main route to the hospital. Larry Thompson, Reed Nelson spoke in opposition to the name change. Mrs. Dual objected to the name of Penn Avenue. Mrs. Neil complained that notices were sent to residences not residents. Gary DeBernardi said this was done so if all changes where not recorded in the Assessors office, the 4 September 21, 1977 Courtday Minutes Page 2 current residents testimony against changing Neff Road motion. Vote was road name changes of the addresses would get the notice. Chairman Montgomery closed the name change. Commissioner Young moved that the matter of to Penn Avenue be dropped. Commissioner Montgomery seconded the unanimous. Don Grubb told the audience that in the future some will be necessary to standardize street names. At this time the Commission held a hearing on the establishment of 30 roads into the county maintained system. Chairman Montgomery read the street names: Chaparrel Drive, Vintage Court, Chaparrel Court, Oxbow Lane, Country View Lane, Old Deschutes Road, Country Squire Road, Azalia Avenue, Gardenia Avenue, Clairaway Avenue, Thomas Drive, Fargo Lane, Pearl Lane, Hyde Lane, Ponderosa Drive, Adams Avenue, Hood Street, Defiance Street, Nugget Place, Emerald Place, Diamond Road, Onyx Lane, Opal Drive, Nugget Avenue, Ruby Place, Boulder Place, Clyde Lane, East Stem Place, Florence Drive, Juniperhaven Avenue. There were no objections at said hearing. Commissioner Young moved that the 30 named roads be established as county roads. Commissioner Grubb seconded the motion. Vote was unanimous. There was no discussion on Road Department or General Fund bills. Bob Montgomery read resolutions of proposed annexations to Rural Fire Protection Dist. No. 2. The first was for the West Half of Section 22, and the West Half of Section 27 in T17S, R13, E.W.M. and the second annexation was for the NEI of Section 10, T17S, Rll, E.W.M. and the NW4 of Section 11, T17S, R11E.W.M. and Section 2, T17S, Rll E.W.M. and the N4 NE4 and the N4 S2 NW4 Section 11, T17S, Rll, E.W.M. Commissioner Grubb moved to set October 19, 1977 as the hearing on the proposed annexations. Com- missioner Young seconded the motion. Vote was unanimous. Don Grubb opened discussion on the proposed new road department office and shops on Arnold Market Road. The Commission received a letter from the Road Advisory Board recommending the county start on the plans for the new buildings. The county has already received a permit to build in this area. Chairman Montgomery asked where the money was coming from for this project. Don Grubb said there was money in the Road Department Building fund and also they planned on using money from the possible sale of the present property the road shop buildings are on. Commissioner Young favors proceeding with this project. He feels shops should be moved because of the safety hazard and traffic congestion operating from the present location. Commissioner Grubb moved the county proceed with their plans to construct the road departmeng shops on Arnold Market Road and that the county crews are authorized to perform a portion of the site grading work prior to the letting of the construction contract. Commissioner Young seconded the motion. Vote was unanimous. Two items, Amendment to Hearings Officer Ordinance No. PL -8 and Proposed Ordinance PL -9, procedural Ordinance for Hearings Officer were cancelled for two weeks to give all involved more time to review these. The Commissioners introduced Eugene Venn, Deschutes County's new Hearings Officer. Lorin Morgan, Planning Director presented the Commission with three zone change requests. The first was by Fischer-Katter form A-1, Exclusive Agricultural to R-1, Urban Residential for property described as the West 484 feet of the following: T17S, R12E, Section 26, Tax lot 506 and T17S, R12E, Section 26 Tax lot 500 on Denser Road between Neff Road and Butler Market Road. This request is consistent with the Bend Area Comprehensive Plan VOL 25 ra875 September 21, 1977 Courtday Minutes Page 3 and has the approval of the Hearings Officer. Don Grubb asked what density R-1 is. Lorin said 14,000 sq. foot lots or 4 lots to an acre without sewer, 6 lots an acre with sewer. Commissioner Young moved this zone change be granted. Commissioner Grubb seconded the motion. Vote was unanimous. Second request was by M.P. Thomas from C-1, Tourist Commercial to C-2, General Com- merical for property described as T17S, R12E, Section 34, tax lot 1200 on Hwy 20 East, next to B&S Tire Store for a car dealership. Said request is consistent with the Bend Urban Area Comprehensive Plan as there already is a dealership in the area. Don Grubb asked what the difference was between C-1 and C-2. Lorin answered that C-2 included dealerships and C-1 did not. Commissioner Young moved that M.P. Thomas be granted the zone change. Commissioner Grubb seconded the motion. Vote was unanimous. Last zone change request was by Robert Shannon from A-1, Exclusive Agricultural to C-2, General Commercial for T17S, R12E, Section 9, the North portion of tax lot 1301 to build a building supply outlet. This matter has the recommendation of the Hearings Officer and is consistent with the Bend Urban Area Comprehensive Plan. Commissioner Young moved to approve the zone change for Robert Shannon. Don Grubb seconded the motion. Vote was unanimous. Chairman Montgomery said the county had received a letter from the Forest Service September 19 saying they had offered Sunriver $6,000,000 for the property in Sunriver and that Sunriver had accepted. The appraisals on the property are available at the Forest Service office. Commissioner Young feels the County Assessor should review the appraisals and report to the Commission. There are three appraisals and they vary from 2 to 12 million dollars difference on each one. Commissioner Grubb feels the county should hold a public hearing before the Commission makes their decision to approve or disapprove the land sale. Chairman Montgomery and Commissioner Young concur. Commissioner Young moved this matter be continued until next meeting, October 5, 1977 and at that time name a date for the public hearing on this matter. Commissioner Grubb seconded. Vote was unanimous. Dave Hoerning presented the Commission with a resolution to establish Industrial Park Blvd. as a county road. This road is the new entrance into the industrial park complex. Commissioner Young moved that November 2, 1977 be set as the hearing on this matter. Commissioner Grubb seconded the motion. Vote was unanimous.
