Smith Omer Summers John Killen Nora Bell George Rede Lucia Venator, secretary Chairman Montgomery opened the meeting at 10:00 a.m. First order of business was the final hearing on annexation of EZNE4 and that portion of WZNE4 lying North of the main Arnold Irrigation Canal, Section 28 and the N2 of Section 27, T18S, R12 E.W.M. to Rural Fire Protection district No. 2. There was no testimony either for or against said annexation. Chairman Montgomery read order. Don Grubb moved they approve the annexation. Abe Young seconded the motion. Vote was unanimous. Scheduled next was the proposed annexation to Choctaw Village Sanitary Dist. This annexation includes two parcels in the vicinity of present boundaries of the sanitary district. Chairman Montgomery called for testimony in favor of annexation. There was none. He then called for testimony against. Mary Gentry was concerned about the main line being within 100' of her well. Dave Hoerning explained there would be no discharge from this line. Harold Gughler asked about a temporary septic site at the Moore Place. Dave said the plans were for a line all the way to the treatment plant in two phases. There would be no holding area. This line will accomodate 575 units when finished. Mrs. Gentry asked if hook up was mandatory. Dave told her no. This system will have any drill holes. DEQ makes these decisions. Asked if there was a specific location yet for the treatment plant, Dave told them no, but possibly it will be north of the Bend Airport. Because of the unanswered questions concerning this annexation, Commissioner Grubb moved this be tabled until October 19, 1977 so Dave can have°answers to the questions asked by concerned property owners. Commissioner Young seconded the motion. Vote was unanimous. At this time Chairman Montgomery read a list of 30 roads to be established as county roads if there are no objections. He called for testimony for or against taking these roads into the county maintained system. There was none. Commissioner Young moved that Pinebrook Blvd, Sherman Road, Old Red Road, Dobbin Road, Mare Court, Dobbin Court, Bronco Lane, Stud Court, Filly Court, Admiral Way, Orion Way, Desert Woods Drive, Mary Way, Vogt Road, Lynn Road, Kandi Court, Tall Pine Avenue, Heritage Avenue, Pine Vista Drive, Woodside Loop, Obsidian Avenue, Somerset Drive, Rincon Avenue, Shoshone Road, King Soloman Court, King Kezekiah Way, King Jehu Way, King Soloman Lane, Boyd Acres Road, and Deer Trail Road all be established as county roads. Commissioner Grubb seconded the motion. Vote was unanimous. October 5, 1977 Court Day Minutes Page 2 Upon the recommendation of the Fair Association, Bill Mayfield, Priday Holmes, Neil Davis and Laddie Jordan were recommended for re -appointment to the Fair Board. All have served faithfully in the past. Don Grubb moved they accept the recommendation of the Fair Association and appoint the four to new terms. Abe Young seconded the motion. The term of Bill Mayfield expires January 1, 1979, Priday Holmes, Neil Davis, and Laddie Jordan terms expire January 1, 1980. Vote on the motion was unanimous. Commissioner Young opened discussion on dog control in Deschutes County. He said effective October 4, 1977 there was new legislation concerning dog control. In the past dog control districts could only be formed in the county. Now they can be formed in cities as well. The new legislation no longer requires counties to pay cities 80% of the sale of dog licenses. Based on this Commissioner Young feels the county should review the contract they now have with City of Bend and notify them to this effect. This matter will be on the October 19, 1977 Court Day agenda. Chairman Montgomery read an order changing the November 16 Court Day to November 15 to enable the Commissioners to attend the Association of Oregon Counties conference in Eugene. Abe Young moved they approve the order. Don Grubb seconded the motion. vote was unanimous. Chairman Montgomery told the audience that a public hearing on the Sunriver-Forest Service land sale will be set to enable the cunty to receive oral and written testimony concerning the land sale. Commissioner Grubb moved that October 18, 1977 at 7:30 p.m. in the Highschool auditorium be set as the hearing date. Commissioner Young seconded the motion. This hearing will be handled like a legislative hearing and only adult conduct will be allowed. Foster Rucker from Sunriver complimented the Commissioners on having the public hearing. Gary DeBernardi questioned taking written testimony. Louis Selken, DA said the county would have to accept all written testimony but they would not have to enter in into the records. Vote on the motion to set October 18 as the public hearing was unanimous. Next item on the agenda was an amendment to Hearings Officer Ordinance No. PL -8 - This amendment spells out duties and functions of a Hearings Officer more clearly than original ordinance. Commissioner Young moved they dispense with reading the amendment and read the title only. Commissioner Grubb seconded the motion. Vote was unanimous. Commissioner Grubb then moved they adopt this amendment. Commissioner Young seconded. Vote was unanimous. The matter of introducing proposed Ordinance PL -9 Procedural Ordinance for Hearings Officer was set aside until October 19. Lorin Morgan, Planning Director presented the Commission with a zone change by Omer Summers from A-1, Exclusive Agriculture to SR -1, Suburban Residential for property lying Easterly of the Oregon Trunk Railway, Southerly of Swalley View, Westerly of Swalley Canal and Northerly of Fred Myers Road in T17S, R12E, Section 16C, tax lot 100; T17S, R12E, Section 16B, tax lot 900 and T17S, R12E, Section 16D, tax lot 300. This request is consistent with the Bend Urban Area Comprehensive Plan and has the approval of the Hearings Officer. Commissioner Young moved this zone change request be granted. Commissioner Grubb seconded the motion. Vote was unanimous. t vc� 0► W.993 A October 5, 1977 Court Day Minutes Page 3 Dave Hoerning presented the Commission withia resolution for the proposed vacation of a portion of Bogue Street, Stearns Street, Salzer Street, portion of 6th Street, Stillwell Street, all of 7th Street, portion of 8th Street, 9th Street in the official plat of LaPine. Dave told the Commission this was being done to extend 6th Street to State Highway 97. Dave has met with property owners and they are all in agreement to do this. Chairman Montgomery asked what they would name the new street. He said probably 6th Street. Commissioner Grubb moved that November 15, 1977 be set as the hearing on this matter. Commissioner Young seconded the motion. Vote was unanimous. Under open discussion, Eileen Donaldson from the Bend Information and Referral Center asked the Commission if they would consider helping finance the Dial A Ride program so they can expand it outside the city limits. They have received many request to expand. Some suggestions for stops outside the city limits are Tumalo, Cimmarron City and Romaine Village. Chairman Montgomery asked if they had worked up any figures on the expense of expanding outside the city limits. She said no but they were hoping maybe the Commission would pay the salary and insurance for a professional driver. Mrs. Donaldson was asked how they knew a person was a senior citizen. She said they have had very few incidents of people trying to use the service who were not qualified. The Commission told Mrs. Donaldson to contact their office and made an appointment when they are ready with their figures. Commissioner Young suggested they check PUC permit requirements for running a bus around the county.
