Purpose of Ordinance. 8 In order to protect the health, safety and welfare of the 9 residents and citizens of Deschutes County and to provide for the 10 control and protection of dogs therein, the Board of County 11 Commissioners for Deschutes County, Oregon, does hereby enact the 12 following provisions which may be referred to and pleaded as the 13 "DOG KENNEL ORDINANCE." 14 Section 2. Definitions. 15 As used in this ordinance, unless the context requires 16 otherwise: 17 1. "Dog" means any mammal of the canine family. 18 2. "Kennel" means the premises must include a building 19 for the housing of dogs, to include inside and 0 20 outside runs with feed and water dishes. J07 W~F W 24 3. "Pet Shop" means any person regularly engaged in 0 25 the business of breeding, buying or selling animals 26 of any species. Page 1 - Ordinance ` r VOL 24 wE 704 1 Section 3. License Fees. 2 Any kennel or pet shop, either of which possesses, controls, 3 owns, boards, keeps, or has custody of, in the course of its 4 business or other activities, dogs which have permanent canine 5 teeth or which are more than six (6) months of age, shall pay an 6 annual license fee of $25.00 for a five (5) or less dog kennel, 7 $50.00 for a six to ten (6-10) dog kennel, and $1.00 for each 8 additional dog over ten (10). Such fee shall be in lieu of all 9 individual dog license fees imposed upon such dogs owned, kept, 10 or boarded at such kennel or pet shop. 11 Section 4. Revocation of Kennel or Pet Shop License. 12 The Board of County Commissioners may, after a hearing and 13 opportunity to be heard, revoke any kennel or pet shop dog license 14 if the person holding such license refuses or fails to comply with 15 this ordinance, or any other State or local laws regarding the 16 keeping of dogs. 17 Any person whose license is revoked shall, within ten (10) 18 days, humanely dispose of all dogs owned by him. No part of the 19 license fee shall be refunded in such case. It shall be a condition 20 of the issuance of any kennel license to any kennel or pet shop that Xor, 21 dog control officers and State of Oregon veterinarians shall be Y~Om° W a T Z m tll r F." 22 jW <Z permitted to inspect all dogs and the premises where such dogs are JF.~y.Z N W I U 7 F'mOW 23 kept at any reasonable time, and the Board of County Commissioners 0 m W Z J JO~M 24 may, if permission for such inspection is refused, revoke the permit 25 of the refusing owner. A copy of this section shall appear on the 26 application of all licenses set forth in Section 3. Upon conviction of any person for violation of any 5 provision of this ordinance, he-shall be punished 6 by a fine of not more than two hundred dollars 7 ($200.00). 8 2. Each day any person shall be in violation of this 9 ordinance shall be deemed a separate offense. 10 Section 6. 11 This ordinance is enacted pursuant to authority granted to the 12 County of Oregon Revised Statutes Chapter 203. 13 Section 7. Severability. 14 If any section, subsection, paragraph, sentence, clause or 15 phrase of this ordinance, or any part thereof, is for any reason 16 held to be unconstitutional (or otherwise invalid), such decision 17 shall not affect the validity of the remaining portions of this 18 ordinance or any part thereof.
