N.W. Montgomery Drive )
BE IT REMEMBERED, that at a term of the Board of County Commissioners
of Deschutes County, Oregon, begun and held at the County Courthouse in Bend in
said County on Wednesday, December 1, 1976, the same being a term of said Board
of County Commissioners sitting for the transaction of County business, at which
time the Board of County Commissioners legally, by resolution, proposed the estab-
lishment of N.W. Montgomery Drive.
That on the said Wednesday, December 1, 1976, the Board of County Com-
missioners did consider that a public necessity existed for the establishment of
said road hereinafter described, and did order that legal notice be given, and
appointed Wednesday, January 5, 1977, as the day of hearing on the establishment
of N.W. Montgomery Drive.
And now at this time it appearing to the Board of County Commissioners
that due notice of this intention and this proceeding has been given, as by law
required, for thirty (30) days or more preceding the day named in said resolution
and said notice for a hearing hereon; and this being after the date for hearing
objections to such establishment, if any therebe, and there were none;
IT IS THEREFORE ORDERED AND DECREED That N.W. Montgomery Dr. shall be
established as described in said resolution and by order herein as follows, to-wit:
A strip of land for street purposes, being 60 feet wide
lying 30 feet on each side of the center line of Montgomery
Drive, N.W. Montgomery and N.W. 30th Street to a point 30
feet easterly of the southeast corner of Lot 8, all in the
plat of Cinder Butte Estates-West as recorded in the office
of the County Clerk and now all of the above said streets
to be named as N.W. Montgomery Drive.
NOW, THEREFORE, IT IS FURTHER ORDERED That the Deschutes County Surveyor
shall file a plat of said road, as surveyed on the ground, with the road records
of Deschutes County.
