23-129-Order Recorded 8/4/19761 IN THE BOARD OF.COUNTY COMMISSIONERS 2 OF THE STATE OF OREGON 3 FOR THE COUNTY OF DESCHUTES 4 In the Matter of ) VOL Amending Article 8 ) ORDER 5 of Deschutes County ) Zoning Ordinance ) 6 7 This matter having come before the Board sitting regularly 8 for the transaction of County business; 9 And it appearing to the Board that the Planning Commission 10 on July 28, 1976, recommended to the Board of Commiss ioners after 11 public hearing,substantially the following amendment to the 12 Deschutes County Zoning Ordinance; 13 And it further appearing to the Board that it. desires, as a matter 14 of County policy,to allow the extension and enlargement of existing 15 non-conforming uses or structures,upon the meeting of certain 16 conditions and approval by the Planning Commission,in order to allow 17 a person the continued effective use of his property; 18 And it further appearing to the Board that it is in the best 19 interests of Deschutes County to permit the extension and enlargement 20 of non-conforming uses or structures under certain conditions; ° WW;0o 21 NOW THEREFORE IT IS HEREBY ORDAINED AS FOLLOWS: X 0.1 f W~YZm N a Z G W 22 The County of Deschutes ordains as follows: Amendment to JF7~2 U X0 NCU°°° Z) d' 23 Deschutes County Zoning Ordinance: 2p -W W 24 8.010 Continuation, Extension and Enlargement of a Non-Conforming 0 25 Use or Structure. 26 1. A non-conforming use or structure existing prior Page 1 - ORDER VOL 23 FAGF 1% 1 to the adoption of this ordinance maybe continued and maintained 2 in reasonable repair, but may not be extended or enlarged except as 3 provided in subsection (2) of this section. 4 2. A non-conforming use or structure may be extended or 5 enlarged upon approval of the Planning Commission after a public 6 hearing held pursuant to Section 11.050. The Planning Commission 7 shall make the following findings: 8 (a) The extension or enlargement does not require increasing 9 the property boundaries.. 10 11 (b) The extension or enlargement will increase the property 12 value of the non-conforming use or structure and will not 13 adversely effect the aesthetic and economic value of adjacent 14 properties. 15 3. In determining whether to approve an extension or enlarge- 16 ment of a non-conforming use or structure, the Planning Commission 17 shall require a site plan.
