6 The Deschutes County Commissioners having previously made a
7 finding of fact and determination that rules are necessary for the
8 efficient use of county,parking facilities, the following rules
9 are hereby established, effective upon the signing of this order:
10 COUNTY COURTHOUSE PARKING RULES
111.1 Definitions:
12 (1) "Vehicle" means any device in, upon, or by which any
13 person or property is or may be transported upon a highway.
14 (2) "Person" means and includes any individual, firm, co-
15 partnership, association, corporation or county department.
16 (3) (a) "Operator" means and includes every individual who
17 shall operate a vehicle as the owner thereof, or as the
18
agent, employee, permittee of
the owner, or is in
19
actual physical control of the
vehicle.

26 (4) "County Employee" means any person regularly or part time

employed by Deschutes County.

(S) "Park" or "Parking" means the standing of a vehicle,
3
whether occupied or not, otherwise than temporarily,
4
for the purpose of, and while actually engaged in,
5
loading or unloading passengers, obeying traffic signals
6
or directions, or involuntary stopping by reason of
7
causes beyond control of the operator.

(6) "Parking Space" means the area delineated by markings
9
upon the surface of the pavement and closed at one end
10
by a barricade or other barricading structure.
11
(7) "Parking Lot" means an area consisting of one or more
12
parking spaces grouped and so designated by appropriate
13
and distinguishing signs or other visible markers.
14 1.2
Parking on property owned or leased by Deschutes County shall
15
be designated as Lots A, B, C, D, a legal description of which
16
is attached hereto and made a part hereof as Exhibit A.
17 1.3
Notice of these rules and regulations, and notice of the use
18
authorized for any particular parking lot or space shall be
19
given by appropriate signs or visible markers posted on the

property, particularly at or near the entrances to or

boundaries of such property, lots and spaces.

Lot "A" shall be limited to persons doing business at the

Courthouse and be limited to one hour, except that parking

spaces shall be designated for each elected official and the
25
following other designated positions: Three loading zone
26
positions at the north entrance to the building; one position

the Sheriff's Chief Criminal
Deputy; two positions near

the
exit for Sheriff's vehicles
for rapid access; one position
3
for
Emergency Services vehicles'
rapid access and one position

for
Dog Control.

2.2 The
Southeast portion of Lot "A"
will be primarily the
6
reserved parking area. No count
y employee shall park any
7
vehicle in the business lot "A"
except as permitted to any
8 person as provided by Section 2.4.
9 2.3 No operator shall park any vehicle in the business lot "A"
10 except while such operator is attending to business at the
11 Courthouse or Courthouse Annex, between the hours of 8 a.m.
12 and 5:30 p.m., Monday through Friday, or unless otherwise
13 permitted by Section 2.4.
142.4 Any person may park in any lot between the hours of 5:30 p.m..
15 and 8:00 a.m. on any Saturday, Sunday or holiday unless other-
16 wise directed by special signs or visible markers, as
17 particularly ordered by the Board of Commissioners.
183.1 Parking lot "B" on the north side of the Annex shall be
19 designated for county employees and visitors doing county
20 business.

provided for such vehicle in lot "B".

4.1
Parking Lot "C" will be the primary parking lot for jurors.

This lot may be used by county employees and visitors doing
4
county business.

5.1
Parking lot "D" may be leased according to terms and conditions
6
arranged and agreed to by the Deschutes County Board of
7
Commissioners. If not, it will be designated as a Courthouse
8
visitor lot.

6.1
Severability. The provisions of this ordinance are severable.
10
If any section, sentence, clause or phrase of this ordinance
11
is adjudged by a Court of competent jurisdiction to be invalid,
12
the decision shall not affect the validity of remaining portions
13
of this ordinance.

6.2
Interpretation. Where the rules and regulations imposed by
15
this ordinance are less restrictive than comparable provisions
16
imposed by any other provisions of this ordinance or any other
17
ordinance or statute, the provisions which are more restrictive
18
shall prevail.
19
7.1
These rules shall be enforced by the Deschutes County Sheriff's
20
Department or the Deschutes County Board of Commissioners.

7.2
A person violating any provision of these rules and regulations

shall be subject to the provisions of ORS 275.440 and ORS 275.990,

providing that such violation is a misdemeanor.

7.3
Penalties:

(1) The recommended penalty for the first citation for violation
26
of this ordinance shall be $.50, which shall double each

1 24 hours up to four days, and which may be paid as a
2 bail for forfeiture. If not paid at that time, a
3 warrant may be issued by the District Court to the
4 violator.
5 (2) The recommended penalty for the second offense shall be
6 $1, which shall double each 24 hours up to four days, and
7 which may be paid at that time. If not paid at that
8 time, a warrant may be issued by the District Court to
9 the violator.

The East 140 feet of the North 232 feet of Block 7,
North Addition to Bend, Deschutes County, Oregon.
Excepting therefrom the Southerly 140 feet of the
Westerly 71 feet.
PARKING LOT B
The North 133.9 feet and the West 150 feet of the
South 140 feet of Block 8, North Addition to Bend,
Deschutes County, Oregon.
Excepting therefrom the following described parcel:
Beginning at a point which is 133.9 feet South and
65 feet West of the Northeast corner of Block 8;
thence West 176 feet; thence North 83 feet; thence
East 176 feet; thence South 83 feet to the point of
beginning.
PARKING LOT C
The North 78 feet of Lot 1; the North 63 feet of Lot
