ORDER ESTABLISHING

BE IT REMEMBERED, that at a term of the Board of County Commissioners
of Deschutes County, Oregon, begun and held at the County Courthouse in Bend in
said County on Wednesday, June 2, 1976, the same being a term of said Board of
County Commissioners si-tting for the transaction of County business, at which
time the Board of County Commissioners legally, by resolution, proposed the
establishment of an access road easement in Ponderosa Pines Subdivision, to be
named Ponderosa Way.
That on the said Wednesday, July 7, 1976, the.Board of County Commissioners
did consider that a public necessity existed for the establishment of said road
hereinafter described, and did order that legal notice be given, and appointed
Wednesday, July 7, 1976, as the day of hearing on the establishment of Ponderosa
Way.
. And now at this time it appearing to the Board of County Commissioners
that due notice of this intention and this proceeding has been given, as by law
required, for more than thirty (30) days preceding the day named in said resolu-
tion and said notice for a hearing hereon; and this being after the date for
hearing objections to such establishment, if anytherebe, and there were none.
IT IS THEREFORE ORDERED AND DECREED that Ponderosa Way shall be esta-
blished as described in said resolution and by order herein as follows, to-wit:
A strip of land 66.00 feet wide lying 33.00 feet on either side of the following
described centerline for the purpose of construction, operation and maintenance
of a road over and across a portion of Section thirty-one (31), Township
twenty-one (21) South, Range ten (10) East of the Willamette Meridian, Deschutes
County, Oregon, the aforesaid centerline being more particularly described as
follows:
Beginning at a point on the southerly right-of-way line of Burgess Road, said
point being North 4831.80 feet and East 3076.14 feet from the Southwest (SW)
corner of said Section 31; thence following along the centerline of said road
South 46° 27' 29" West 2595.27 feet; thence along the arc of a 845.00 foot
radius curve to the left 281.63 feet, the chord of which bears South
36° 54' 36" West 280.33 feet; thence South 27° 21' 43" West 67.59 feet; thence
along the arc of a 1090.00 foot radius curve to the left 485.40 feet, the
chord of which bears South 14° 36' 16" West 481.40 feet; thence South
01° 50' 49" West 1310.84 feet; thence along the arc of a 820.00 foot radius
curve to the right 584.94 feet, the chord of which bears South 22° 16' 58"
West 572.62 feet; thence South 42° 43' 07" West 362.52 feet; thence along
the arc of a 287.65 foot radius curve to the left 204.32 feet, the chord of
which bears South 22° 22' 10" West 200.05 feet, to a point on the south line
of said Section 31 and there terminating, said point of termination bearing
North 89° 29' 43" East 292.67 feet from the southwest corner of said Section 31.
Contains 8.94 acres, more or less.
NOW, THEREFORE, IT IS FURTHER ORDERED that the Deschutes County Surveyor
shall file a plat of said road, as surveyed on the ground, with the road records
of Deschutes County.
