This matter coming before the Board of Commissioners upon
the unanimous recommendation of the County Planning Commission,
who held a public hearing on this matter on May 18, 1976,
And it appearing to the Board upon reviewing the Planning
Commission record in this matter that this ordinance amendment
is necessary and in the public interest:
Section 8.030 is amended to read:
Section 8.030 Change in Non-Conforming Use
1. If a non-conforming use is replaced by another use in
an area which is designated as an urban area by the
Comprehensive Plan, the new use shall conform to the
requirements of the zone in which the use is located.
2. A non-conforming use of an existing structure within
an area designated as a rural area by the Comprehensive
plan may be changed to a use similar in general nature
to the pre-existing non-conforming use, although such use
does not conform to the requirements of the zone in
which it is located, upon approval of the Planning
Commission. In considering whether to approve the
change in use, the Planning Commission shall determine
that:
(a) The new use would not require an extension or
enlargement of the existing structure; and,
(b) The refusal to allow the change in use would
constitute a loss of investment to the owner
of the property; or,
(c) The refusal to allow the change in use would
adversely affect the tax valuation of the
subject property.
