21-891-Order Recorded 2/4/1976IN THE BOARD OF COUNTY COMMISSIONERS IN THE STATE OF OREGON FOR THE COUNTY OF DESCHUTES In the Matter of File No. Z-76-1 ) O R D E R Initiated Zone Change from R-2, Urban ) Residential to C-1-T, Tourist Commer- cial with Transitional Standards ) VOL 21 PAGE 8591 This matter coming before the County Commission upon the Planning Commission's recommendation who held a public hearing on this issue, January 14, 1976, and unanimously recommended approval, . And it appearing to the Board upon reviewing the Planning commission record in this matter that the following facts were established: 1. There exists several multiple family apartment buildings East and South of the site. 2. The site is bordered on the West by a C-1 Tourist Commercial Zone. 3. An office facility would comply with the Transitional Standards as outlined in Section 5.070, requiring that an orderly, proper and harmonious transition between different zones and uses be established. 4. The existing structure was created for and has in the past been utilized as an office facility. 5. Development of the site as a multiple family dwelling unit would be difficult because of the size of the site, the limited access onto the site from Parrell Road, and the potential hazard existing due to the COI Canal bordering the rear property line. 6. This zone change application complies with the purpose of the Deschutes County Zoning Ordinance and the Comprehensive Plan in promoting the orderly growth of Deschutes County and encouraging the most appropriate use of land. And it further appearing to the Board that these facts support the pro- posed zone change, and, The County Commission deeming this action to be in the public interest, IT IS HEREBY ORDERED that the zoning of the following described property be changed from R-2, Urban Residential, to C-1-T, Tourist Commercial with Transitional Standards as shown on the attached map and described as follows: A portion of Tract 18 of Reed Highway Acreage, Section 2, more particularly described as follows: Beginning at the Northeast corner of said Tract 18; thence South 31°32'30" East a distance of 21.91 feet; thence Southwesterly a distance of 289.18 feet along the arc of a circle whose radius is 256.50 feet; to a 1/2" iron bar; thence North 56°17'30" West a distance of 124.0 feet; thence North 22°00' East a distance of 187.52 feet to the point of beginning. SUBJECT TO THE FOLLOWING "T" STANDARDS: 1. That any expansion of the existing facilities be subject to site plan review by the Planning Commission as required in the C-1 Zone. J Page 2. Medical or dental clinic. C. Mail order business. d. Caretaker's residence. 3. That the access be limited to that which is existing from Parrell Road at the Southeast corner of the site. 4. That a site plan be submitted when the building is to be occupied for commercial purposes in order that the Planning Commission can review the parking requirements as required by the Zoning Ordinance. (This site plan approval will only be necessary with the first commercial use, unless it becomes apparent that additional parking requirements will be necessary as the building reaches its maximum commercial use.)
