7 THE COUNTY OF DESCHUTES ORDAINS AS FOLLOWS:
8 Section I. PROHIBITION.
9 No person shall fire or discharge any weapon which acts by force
l0of explosive, except as provided in Section II hereof, within an area
lldesignated as a restricted area pursuant to Section IX of this
12 ordinance.
13 Section II. EXCEPTIONS.
14 Section I of this ordinance shall not apply to:
15 (a) A person acting in defense or protection of his property
16 or of an individual.
17 (b) A peace officer acting in the course of his duty.
18 (c) A lawfully established firing range,
19 Section III. DEFINITIONS.
20 As used in this ordinance words shall have the following meanings:

Na-F. (b) "Restricted Area" means an area restricted pursuant to

W 24 Section IV. PETITION FOR RESTRICTED AREA.

25 A proposal for formation of a restricted area shall be made by
26 petition. The petition shall contain the following:

1 (a) A .description of the boundaries of the proposed
2 restricted area.
3 (b) A statement that the area is proposed to be restricted
4 pursuant to the provisions of this ordinance.
5 (c) The signatures of not less than 60 percent of the
6 registered voters resident within the territory proposed to be
7 restricted.
8 Section V. REQUIREMENTS FOR SIGNERS OF PETITIONS.
9 (a) Each person signing a petition shall also print his
10 name on the petition and shall add after his signature his place of
11residence giving street and number or a designation sufficient to
12enable the place of residence to be readily ascertained.
13 (b) After a petition has been offered for filing a person
14may not withdraw his name therefrom.
15 (c) A petition may designate not to exceed three persons
16 as chief petitioners, setting forth their names and mailing addresses.
17A petition may consist of a single instrument or separate counterparts.
18 Section VI. TIME LIMIT FOR SECURING SIGNATURES.
19 (a) A petition shall not be accepted for filing unless
20the signatures thereon have been secured within 6 months of the date

26 (c) Within ten days after the date the petition is offered

1 for filing, the County Clerk shall examine the petition and determine
2 whether it is signed by the requisite number of qualified signers.
3 If the requisite number of qualified signers have signed the petition,
4 the Clerk shall forward the petition to the Board. If the requisite
5 number have not signed the petition the Clerk shall notify the chief
6 petitioners and may return the petition to the petitioners.
7 (d) A petition shall not be filed unless the certificate
8 of the County Clerk is attached thereto certifying that he has compared
9 the signatures of the signers with the appropriate records; that he
10 has ascertained therefrom the number of qualified signers appearing
llon the petition and that the petition is signed by the requisite
12 number of qualified signers.
13 Section VII. NOTICE OF HEARING.
14 (a) Following receipt of the petition from the County Clerk,
15the Board shall set a date for hearing not less than fifteen days nor
16 more than 45 days after the date the petition is received by the Board.
17 (b) The Board shall cause notice of the hearing to be posted
18in at least three public places within the proposed restricted area
19 and published once by insertion in a newspaper of general circulation
20in the restricted area not less than seven nor more than fourteen days

1 that notice be given to the non-appearing registered voters within the
2 area omitted. The hearing may not be continued for more than fifteen
3 days.
4 Section VIII. FORMATION OF RESTRICTED AREA.
5 If after hearing the petition the Board determines that the area
6 would benefit by the restrictions of this ordinance,it may enter an
7 order stating that the area petitioned to be restricted, and as may be
8 amended, shall be subject to the provisions of this Ordinance. Said
9 order may take effect immediately upon passage if an emergency is
10 declared. If an emergency is not declared the ordinance shall take
11 effect 90 days after the date of the order.
12 Section IX, VIOLATIONS.
13 Violation of the provisions of this ordinance is punishable upon
14 conviction by a fine of not more than $250.00.
15 Section X. DECLARATION OF EMERGENCY.
16 This ordinance being necessary to insure the public health, safety
17 and welfare, an emergency is declared to exist and this ordinance shall
18 be effective immediately upon passage.
