H. Fuqua, John J. Killen and William F. Jones, and Lucia Venator, Secretary were present at the morning session. IN THE MATTER OF GRANTING AN EASEMENT TO MARK LATTA: At this time the Commission granted an easement to Mark Latta for purposes of ingress and egress in Section 26, Townhip 14 South, Range 13 East of the Willamette Meridian, Deschutes County, Oregon. IN THE MATTER OF CONTRACT WITH EDWARD S. DALEY: At this time the Commission entered into contract with Edward S. Daley for the purpose of providing the daily maintenance and operation of the Deschutes County Southwest Sanitary Landfill Site. This contract shall be for six months from April 15, 1975 to September 15, 1975. The Contractor shall provide the County with a performance bond for not less than $9,252.00. The County shall pay to Contractor the amount of $1,542.00 per month for this service. IN THE MATTER OF FORMATION OF A PROPOSED PARK AND RECREATION DISTRICT: At this time the Commission ordered that a public hearing be held on the proposal of a Park and Recreation District on April 21, 1975, at Redmond City Hall, Redmond, Oregon. A final hearing is ordered for May 15, 1975 at 7:30 p. m. Redmond City Hall, Redmond, Oregon. This park and recreation district is to be known as Central Oregon Park and Recreation Dist. IN THE MATTER OF CONTRACT RESCISSION TO CHARLES D. AUSTIN, JOHN C. BURROW, AND KENTON R. NELSON: At this time the Commission entered into a contract rescission with Charles D. Austin, John C. Burrow, and Kenton R. Nelson, pertaining to the sale of real property, December 14, 1973 in Deschutes County, Oregon to wit: SW-14, NE4, Sec. 25, Twp. 17 S., Range 12 E., W. M. The seller will refund to buyer the amount of money paid toward this contract plus interest at the rate of 8% per annum from the date paid to April 30, 1975. IN THE MATTER OF SALE OF REAL PROPERTY TO CHARLES D. AUSTIN, JOHN C. BURROW, KENTON R. NELSON: At this time the Commission ordered the Deschutes County Treasurer to pay to Charles D. Austin, John C. Burrow, and Kenton R. Nelson, as Tenants in Common, the amount of $5,325.81, being the amount of principle plus interest at the rate of 8% per annum from the date of pay- ment to April 30, 1975, for rescinded contract entered into on December 14, 1975 for the sale of real property located at SW-I,, NE4, Sec. 25, Twp. 17 S., Range 12 E., W. M., Deschutes Co. Oregon. 4 IN THE MATTER OF , VOL 20 PAGE 54 THE VACATION OF AN ALLEY IN BLOCK 24, LAIDLAW (TUMALO): At this time the Commission acting upon the petition of Laura Jean Elliott, Jacob M. Wolfe, and Harley E. Farris, Route 6 Box 575, Bend, Deschutes County, Oregon, resolved to vacate the following described alley, to wit: All that portion of the alley running north and south between Sixth and Seventh Streets, Block 24, in Laidlaw (Tumalo). It is therefore ordered that copies of this resolution, duly certified to as such by the County Clerk, shall be posted in three (3) places along the road to be vacated, and that a copy of this Resolution be placed on the Bulletin Board in the entrance of the Deschutes County Courthouse and Courthouse Annex, Bend, Oregon, that Wednesday, May 21, 1975 at 10:00 a. m. at the Deschutes County Courthouse Annex, Conference Room "A", Bend, Oregon, be and the same is hereby fixed as the time and place for the hearing of objections, if any therebe, why said alley should not be vacated. IN THE MATTER OF ESTABLISHEMNT OF ROADS: The Commission on April 16, 1975 held. a Hearing on the establishment of Pitts Drive, Cooper Place, Craven Road, Tempest Drive and Mustang Place, and beings there were no objections nor remonstrances did Order and Decree that Pitts Drive, Cooper Place, Craven Road, Tempest Drive and Mustang Place be established as described in Resolutions dated March 5, 1975 as County Roads in Deschutes County. The legal descriptions are given in the Commission minutes of March 5, 1975. IN THE MATTER OF NOTICE OF PUBLIC HEARING: At this time the Commission stated that they will hold a public hearing on April 30, 1975 at 10:00 a. m. in Conference Room A., Courthouse Annex, Bend, Oregon for the purpose of hearing objections to the transfer of real property to the City of Redmond to be used for the extension and improvement of the Roberts Field, Redmond Municipal Airport. IN THE MATTER OF LEASE WITH ALVES: At this time the Commission granted a Deschutes County Grazing Lease to Maynard and Jacolyn Alves on property described as: A parcel of land located in Township 18 South, Range 13, E. W. M., Section 10: SW4, 160 acres, SW-1,- SE-4, 40 acres, Section 15: W2 320 acres, NW-14, 160 acres, N2 SE-14, 80 acres. Term of lease is five years and Lessee agrees to pay $50.67 for the period from May 1, 1975 to December 31, 1975 and thereafter annually on the 1st day of January, the sum of $76.00. This lease coversapproximately 760 acres. IN THE MATTER OF LEASE WITH TIC CATTLE CO.: At this time the Commission granted a Deschutes County Grazing Lease to Tic Cattle Co., Inc., Gil Ticoulat, President on property described as Exhibit A. Term of lease is five years and Lessee agrees to pay $413.64 for the period from May 1, 1975 to December 31, 1975 and thereafter annually on the 1st day of January, the sum of $750.55. This lease covers approximately 2602 acres. IN THE MATTER OF DEVELOPMENT PLAN AGREEMENT WITH OREGON STATE HIGHWAY DIVISION: At this time the Commission entered into a Development Plan Agreement with the Oregon State Highway Division for improvements and maintenance of the Hampton Quarry Site. IN THE MATTER OF DEVELOPMENT PLAN AGREEMENT WITH ROBERT COATS: At this time the Commission entered into a Development Plan Agreement with Robert Coats for the improvement and maintenance of the Lizard Creek - Excavation Site. 5 IN THE MATTER OF ENCROACHMENT PERMIT ON A PUBLIC ROAD: VOL 20 FAGE 5 5 At this time the Commission ordered that permission be granted to Robert D. and Lila M.
