21-485-Order Recorded 11/5/1975a- 11~_ IN THE BOARD OF COUNTY COMMISSIONERS IN THE STATE OF OREGON FOR THE COUNTY OF DESCHUTES In the Matter ) VOL 21 FACE 485 of ) O R D E R Establishing Eligibility ) for the National Flood ) Insurance Program ) WHEREAS, the COUNTY OF DESCHUTES has adopted and is enforcing the UNIFORM BUILDING CODE, STATE OF OREGON, and the DESCHUTES COUNTY ZONING ORDINANCE, and WHEREAS, Section 301 (a) of the aforesaid Building Code and Section 2.010 of the aforesaid Zoning Ordinance prohibits any person, firm or corporation from erecting, constructing, moving, enlarging, altering, repairing, improving, or demolishing any building or structure without obtaining a separate building permit for each building or structure from the Deschutes County Planning Director and the Deschutes County Building Official, and WHEREAS, the DESCHUTES COUNTY BUILDING DEPARTMENT must examine all plans and specifications for the proposed con- struction when application is made to them for a building permit. NOW, THEREFORE, BE IT ORDERED by the Board of Commissioners of Deschutes County as follows: 1. That the Deschutes County Building Department shall review all building permit applications for new construction or sub- stantial improvements to determine whether proposed building sites will be reasonably safe from flooding. If a proposed building site is in a location that has a flood hazard, any proposed new con- struction or substantial improvement (including prefabricated and mobile homes) must (i) be designed (or modified) and anchored to prevent flotation, collapse, or lateral movement of the structure, (ii) use construction materials and utility equipment that are resistant to flood damage, and (iii) use construction methods and practices that will minimize flood damage; and 2. That the Deschutes County Planning Commission shall review subdivision proposals and other proposed new developments to assure that (i) all such proposals are consistent with the need to minimize flood damage, (ii) all public utilities and facilities, such as sewer, gas, electrical, and water systems are located, elevated, and constructed to minimize or eliminate flood damage, and (iii) adequate drainage is provided so as to reduce exposure to flood hazards; and 3. That the Deschutes County Health Department or Department of Environmental Quality shall require new or replacement water supply systems and/or sanitary sewage systems to be designed to minimize or eliminate infiltration of flood waters into the systems and discharges from the systems into flood waters, and require on-site waste disposal systems to be located so as to avoid impairment of them or contamination from them during flooding.
