DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, JUNE 289 2004
Commissioners' Meeting Room - Administration Building

Present were Commissioners Michael M. Daly and Tom De Wolf; Commissioner
Dennis R. Luke was out of the office. Also present were Mike Maier, County
Administrator; Susan Ross, Commissioners' Office; and Architects Scott Steele and
Lance Olivieri. No representatives of the media or other citizens were present.
The meeting began at 1:30 p.m.
1. Discussion of City Requirements for Justice Center Project.
Susan Ross explained that the Justice Center project is being severely delayed
because permits from the City of Bend are being held up for a number of
reasons.
Scott Steele stated that there have been staffing changes in the City's building
department, resulting in a long list of possible code violations. There were
thirty-two items listed, most of which have been resolved. However, the City
now states that there is a "yard" issue - a ten -foot overlap of the jury assembly
room by the basement area, and also says that the entrances may be too close
together. To offset this requirement, the City wants the sprinkler system to be
retrofit to include the jury assembly area, resulting in unforeseen expenses.
He further explained that this specific item is not the big issue. The problem
is that the City building staff signs off on plans and then come back with more
requirements; they won't stay with their decisions. He voiced concerns that
even if they accommodate the additional sprinkler system, the City will come
back with even more requirements.

He said is trying to be tactful so that he does not alienate them, which could
make the situation worse. However, it is becoming increasingly difficult, and
all of the delays are adding to the cost of the project. He said this is not
unique to his company or this project; other companies have been
complaining about the problem for some time.
The Commissioners said that this attitude is not new; delays of this kind have
been experienced during a number of County projects. Although the Central
Oregon Builders' Association can have some impact on residential building,
there is no representation to help out commercial builders in this regard.
Ms. Ross added that City staff was agreeable to having the County pay the
appropriate fees but do its own plans examinations and inspections, but she
was assured that the City could get the work done quickly.
Mike Maier and the Commissioners may discuss this issue with City
representatives, if they can do so without making the situation worse. In the
meantime, they instructed Ms. Ross to look into having the County do its own
plans examinations and inspections as was done by agreement with the City
for the warehouse and County/State buildings.
DEWOLF: Move that an agreement be made between the County and City
allowing the County to handle its own plans review and
inspections on this project.
DALY: Second.
VOTE: DEWOLF: Yes.

Ms. Ross then provided a handout to the Commissioners regarding the Justice
Center project. The original estimates were low, and the delays caused
primarily by the City are driving up the costs. The majority of the Courthouse
remodel involves bringing the restrooms up to standards.
The group then discussed how to handle funding the shortage, in order to meet
the required contingency amount.

2. Overview of Other Projects.
Ms. Ross said that the remodel of the old Administration building is well
underway. The at
on Children & Families, the United Way, the
Family Resource Center, the Senior Mental Health Program, Risk
Management and the child care facility will be housed in the building upon
completion.
The Commissioners directed Ms. Ross to provide them with a spreadsheet
giving an overview of the status of the project fund.
3. Other Business.
Mike Maier explained that the County's grant writer, Judith Ure, was offered a
position with Multnomah County. The Commissioners feel it is important to
keep Ms. Ure with Deschutes County if at all possible.
