PAC, 1 IN THE COUNTY COURT OF THE STATE OF OREGON 2 FOR THE COUNTY OF DESCHUTES 3 In the Matter of an Ordinance ) COUNTY ORDINANCE 4 Regulating theControl and ) Disposition of Dogs within ) No: 203-'1 Des chutes County ) (aka The June Fox Law) 6 THE COUNTY Co ' ssiWOF I3 S HUTES COUNTY ORDAINS AS FOLLOWS: 7Section 1 8 A dace is 4 �ublic ;"4 ui:sance `it: a 9 (1) Bites a person; 10 (2) Habitually'"chases vehicles or persons; 11 (3) Dam*g+es or d"troys- property,of 12 persons -otherthan ,.tfie owner of the dog; 13 (4) Scatters garbage; 14 (5) Habitually trespasses on private property of persons other, than the owner of the dog; 15 (6) Disturbs any person'by frequent or prolonged noises; or 16 (7)' Is a female in heat and running at large. 17 Section 2 18 When a dog is'alleged tobe a public nuisance under Section One 19 of this ordinance, every police officer, sheriff, deputy or dog control officer shall impound ity or notify the owner 2U in writing to temporarily restrain the dog, and the allegations-., made about the,dog 21 Section 3 22 All dogs taken up and impounded under this ordinance shall be 23 held in an adequate and sanitary ,facility ` facility' as required by the laws of the State of.Oregon.,Any dog so impounded shall be 24 held for at least 5 days from the date of such impounding before being destroyed or otherwise disposed-of 25 26 Page 1 of 3 - County Ordinance No. 203-1 1Section 4 2 If the dog is impounded, the dog control officer shall notify the owner of such <:dog, of the fact of impounding -:and the alleged 3 reasons therefore. He,sh-ll alsosubsequentlygive notice of the time and ,place the matter will be heard by the Dog Control 4 Board. -I-f the dog is`unlicensed, or no owner can be ascertained within five days from its impounding, it shall be killed in a 5 humane rdanner. The provisions of the ordinance are subject to, and 'Aupercei3ed by, any existing and applicable law of the State 6 of Oregon providing for rabies control. 7Section 5 - g The evidence supporting,the allegation that the dog is a nuisance shall`be,presented to the Dog Control Board, If the is, Control g Board determines said dog is not a nuisance as defined by Seotion One, it may release such dog to the user or any responsible 10 person who will properly care for such dog and not allow it to become a nuisance, and upon payment of such fees and 'costs as 11 prescribed by Section Seven of this 'ordinance. If the .Dog Control :Board determines such a dog'to be a nuisance as defined by Section 12 One, Item One, of this ordinance, andif in the opinion of the. Dog Control Board it was a vicious attack, it may order it to be 13 killed, in a humane manner. 14 Section 6- 15 The owner of a dog ordered destroyed`by the Dog Control Board has a right to appeal such decision to the Deschutes County Board of 16 Commissioners. Notice of appeal shall be'in writing and delivered to the Board of Commissioners by the owner of such dog within 17 three days of the decision of the Dog'Control Board: Upon receipt of such notice, the Board of Commissioners shall set a time and 1g place,' within ten days after the decision, of the Dog Control Board, and notify interested parties of said time and place, for 19 a review'of the findings of the Dog Control Board..
