M. Van Horn, Hollis C. Carlile, Claud Elwood Jr., Arthur Baltzor, N. J. Donat, Debra L. Davis and Lucia Venator, Secretaries were present at the moring session. IN THE MATTER OF TEN MILE BIKE RACE: At this time the Commission granted permission to the Redmond Highschool French Club to conduct a ten mile bicycle race similar to the one held last year. The County Road Dept. and the Sheriff's Dept. will assist them. - 3 - VOL 19 :ME IN THE MATTER OF RE -APPOINTMENT TO THE LIBRARY BOARD: At this time the Commission re -appointed Mrs. Sue Hollern and Mr. Mille Shannon to the Deschutes County Library Board for two year terms expiring on January 1, 1977. IN THE MATTER OF APPOINTING MRS. LINDA LYNN TO THE DESCHUTES COUNTY LIBRARY BOARD: At this time the Commission appointed Mrs. Linda Lynn to the Deschutes County Library Board for a four year term expiring January 1, 1979. IN THE MATTER OF ELECTION SERVICE AGREEMENT: At this time the Commission entered into agreement with Cubic Industrial Corporation, 4285 Ponderosa Avenue, San Diego, Calif. C.I.C. will provide election support services and the furnishing of necessary replacement parts on Cubic vote Counters and Cubic Buffers, owned or leased by the Customer for the fees and for the coming year shown below: Two vote counters, Model No. 5-62, total Fee Contract Year, $2,100.00. The Agreement is effective as of July 1, 1975 thorugh and including, the contract year ending June 30, 1976. IN THE MATTER OF ANNEXATION TO RURAL FIRE PROTECTION DISTRICT #2: The Commission, on March 19, 1975 held Final Hearing and, beings there were no requests for an election filed with the Board of Commissioners and there were no objections nor remonstrances at Hearing, Ordered that the following described area be and it is hereby annexed to the Rural Fire Protection District #2, Deschutes County, Oregon. SZ Section 2 and SW; of Section 1, Township 18, Range 13, E.W.M. IN THE MATTER OF ANNEXATION 70 CLOVERDALE RURAL FIRE PROTECTION DISTRICT: The Commission, on March 26, 1975 held Final Hearing and, beings that were no requests for an election filed with the board of Commissioners and there were no objections nor remonstrances at Hearing, Ordered that the following described area be and it is hereby annexed to the Cloverdale Rural Fire Protection District, Deschutes County, Oregon. PL -5: At this time the Commission Ordered that upon the Planning Commission's recommendation who held a public hearing on this issue, March 5, 1975, and unanimously recommended approval, and the County Commission deeming this action to be in the public interest and consistent with the Comprehensive Plan for Deschutes County, that the amendments to Deschutes County Zoning Ordinance No. PL -5 be adopted, to become effective immediately. IN THE MATTER OF ZONE CHANGE REQUEST BY DESCHUTES COUNTY: At this time the Commission Ordered that the zoning of the following described property be changed from A-1 Exclusive Agricultural to RR -1 Rural Recreation Residential: Pine Crest Ranch west of Highway 97, Township 21 South, Range 10 East, Section 24, Willematte Meridian, LaPine, Oregon. To become effective immediately. IN THE MATTER OF WAGES FOR ELECTION WORKERS: At this time the Commission Ordered that the Deschutes County Clerk pay election board workers $2.00 per hour and the election board chafemen $2.25 an hour for their services during election. IN THE MATTER OF CLOSING MARINE FACILITY IMPROVEMENT FUND: At this time the Commission Ordered that because the need for the Marine Facility Improve- ment Fund has ceased, the Deschutes County Treasurer, pursuant to ORS 294.475, close the Marine Facility Improvement Fund and transfer the balance of $537.98 into the General Fund. IN THE MATTER OF FORMATION OF A PROPOSED PARK AND RECREATION DISTRICT: At this time the Commission Ordered that the formation of a proposed park and recreation district to be called Central Oregon Park and Recreation District as described per Order, have a Hearing held on the proposal on April 21, 1975 at 7:30 P.M. at the Council Chambers, Redmond City Hall, Redmond, Oregon at which time all interested persons may appear and be heard and that notice thereof be given as provided by law. IN THE MATTER OF ISSUANCE OF A FRANCHISE TO COLLECT SOLID WASTES: At this time the Commission Ordered that Joseph M. Chotard and John A. Chotard DBA Bend Gargabe Company be granted a special franchise for the collection of solid wastes and wastes as applied for a perior to end December 31, 1984. - 5 - VOL 19 PAL` 9 `: IN THE MATTER OF WITHDRAWING FROM LCDC: At this time the Commission Resolved that Deschutes County take affirmative action in the State Legislature to remove Deschutes County from the authority of the Land Conservation and Development Commission or any other similar State wide agency which dictates to counties how to plan their growth. IN THE MATTER OF AMENDMENT TO PERSONNEL RULES AS ADOPTED ON JUNE 25, 1973: At this time the Commission Resolved that amendments to the Personnel Rules as adopted June 25, 1973, Section 3.35 Eligibility for Salary Increase to Read: If a cost of living increase is approved, all employees shall be eligible for the increase. A newly hired employee shall be eligible for a merit increase (not to exceed 2 steps or 5%) upon the successful completion of his trial service period. IN THE MATTER OF VACATION OF SECOND UNIT OF VALLEY RIDGE ACRES: At this time the Commission Resolved to vacate the described plat per resolution. The copies of the resolution, duly certified to as such by the County Clerk, shall be posted in three places along the roads to be vacated, and that a copy of the resolution be placed on the Bulletin Board in the entrance of the Deschutes County Courthouse, Bend, Oregon; that Wednesday May 7, 1975 at 10:00 a. m. at the County Courtroom, Courthouse Annex, Bend, Oregon be and the same is hereby fixed as the time and place for the hearing of objections. IN THE MATTER OF RESOLUTIONS TO ESTABLISH ROADS: At this time the Commission made Resolution of its intention to establish County Roads in Deschutes County, Oregon described: ROGERS ROAD: A strip of land sixty (60) feet in width, being thrity (30) feet on each side of the following described centerline: Beginning at the intersection of the centerline of the old Bend -Redmond Highway No. 375 and the section line between Section 5 & 8 of Township 17 South, Range 11 East of the Willamette Meridian, Deschutes County, Oregon: thence North 890 52' 43" East 575.38 feet to the quarter corner between said Section 5 & 8; thence north 890 47' 43" East 2647.75 feet to the section corner of Section 4, 5, 8 & 9; thence North 890 55' 20" East 1306.50 feet to the West 1/16 corner between Section 4 & 9, also being the centerline of W. X. Hunnell Road, and there terminating. Now, therefore, it is hereby ordered that the County Roadmaster or his duly qualified deputy, shall give notice of this Resolution by posting three copies thereof, properly certified to as such by the County Clerk, at the place of holding County Court and also at three public places in the vicinity of said proposed road thirty days previous to the consideration of this Resolution by the Board of County Commissioners, notifying all persons concerned that said Resolution will be considered and passed upon by the Board of County Commissioners at a meeting on the seventh day of May, 1975, at which time the Board of County Commissioners will consider any objections or remonstrances which may be filed on account of said proposed roads.
