19-117-Order Recorded 9/4/1974IN THE BOARD OF COUNTY COMMISSIONERS OF THE STATE OF OREGON FOR THE COUNTY OF DESCHUTES In the Matter of Zone Change Request from R-1, Urban Residential and A-1-40, Exclusive Agriculture, 40 acre parcels to A-1-10 Exclusive Agriculture, 10 acre parcels by Brooks Resources `JJ� 19 PAUE 11'7 0 R D E R oZ 3 This matter coming before the County Board of Commissioners upon the Planning Commission's recommendation who held a public hearing on this issue August 13, 1974, and unanimously recommended approval, and, The County Board of Commissioners accepting the Planning Commission's action to change the zone and deeming this action to be in conformance with the Oregon Supreme Court requiring that the zone change is in conformance with the Comprehensive Plan for Deschutes County, that there has been shown a public need for change which can be identified within the objectives of the Comprehensive Plan, that the public need specified is best met by the zone change, and that the zone change conforms to the general welfare standards in the enabling legislation which can be identified within the report of the Planning Commission justifying the change. IT IS HEREBY ORDERED that the zoning of the following described property be changed from R-1 Urban Residential and A-1-40 Exclusive Agriculture, minimum 40 acre parcels to A-1-10, Exclusive Agriculture with 10 acre parcels: A tract of land lying in the NE 1/4 of Sec. 4, and lying in the West 1/2 of Section 3, Township 15 South, Range 10 East of the W.M. BEGINNING at a point on the Easterly right-of-way line of Wilt Road (Camp Polk Road), said point further being on the East-West center section line of said Section 4; thence Easterly along said center section line to the West 1/4 corner of said Section 3; thence southerly along the West line of said Sec. 3 to the SW corner of said Sec. 3; thence Easterly along the South line of said section to a point on the centerline of Indian Ford Creek; thence North- westerly along said centerline of said creek to a point on the North line of said Sec.3; thence Westerly along said section line to the Northeast corner of Sec. 4; thence Westerly along the North line of said Sec. 4 to a point on the Southeasterly right-of-way line of the Northeast -Southwest runway of the Sisters Airport;thence Southwesterly along said right-of-way line to a point of intersect with a Northerly projection of the West line of that tract of land deeded to Evan Lowe: Thence South along said projected line and along the West line of said tract to the Southwest corner of said tract; thence East along the South line of said tract to the Southeast corner of said tract; thence due South to a point on the Northerly right-of-way line of Barclay Drive; thence Southwesterly along said right-of-way line to a point on the Easterly right-of-way line of Wilt Road (Camp Polk Road); thence Southerly along said right-of-way line of said Wilt Road to the point of beginning and terminus of this description. VOL FAV.1118 ALSO EXCEPTING THEREFROM: That tract of land lying in the Southwest 1/4 of the Southwest 1/4 of the Northeast 1/4 of said Section 4, being more particularly described as follows: Commencing at the North 1/4 corner of said Section 4; thence South 2479.38 feet and East 3.62 feet to the true point of beginning of this description, said point also being on the North-South center section line of said Section 4; thence leaving said line South 89021'24" East 147.36 feet; thence South 00006'26" West 109.11 feet to a point on the East-West center section line of said Section 4; thence South 89049'54" West along said line 146.99 feet to the Center 1/4 corner of said Section 4; thence North 00005'01" West along said North-South center section line of said Section 4 111.20 feet to the point of beginning and terminus of this description.
