This matter coming before the County Commission for the
purpose of compliance with Senate Bill 73, State-wide Building Code, and,
The Commission deeming this action to be in the public .interest
to establish provisions to implement Senate Bill. 73, State-wide Building
Code;
IT IS HEREBY ORDERED That the following provisions be adopted
with respect to the Building Code of the State of Oregon and Deschutes
County for the construction, enlargement, alteration, repair, moving,
removal, conversion, demolition, occupancy, equipment, use, height, area
and maintenance of buildings or structures within the unincorporated
areas of Deschutes County, along with the collection of fees to defray
administrative costs:
BE! IT ORDAINED BY THE BOARD OF COMMISSIONERS FOR DESCHUTES
COUNTY, OREGON, that:
Certain books or publications and laws, copies of which are
on file in the Office of the Deschutes County Clerk, marked
and entitled "Oregon State Structural and Fire and Life
Safety Code," "Oregon State Mechanical Specialty Code,"
"Uniform Code for the Abatement of Dangerous Buildings,"
1973 Edition, the Oregon State Plumbing Laws as contained in
0. R. S. CHAPTERS 447, 670 and 693 and the Administrative Rules
adopted thereunder, are adopted as the Building Code for
the unincorporated areas of Deschutes County, Oregon except
Table 3A and Appendix Chapter 13, of the Oregon State Structural
and Fire and Life Safety Code, and the fees(see attached
schedule) prescribed by Section 304 of the Oregon State
Mechanical Specialty Code, Figures 23B10 and 23B14 (see
attached map), are not adopted. It shall be the duty of
the Deschutes County Building Administrator to enforce the
provisions of the aforementioned code.
INTERPRETATIONS AND DEFINITIONS: In applying the
provisions of the Oregon State Structural and Fire and Life
Safety Code, to construction on the County, the following
interpretations will be used:
APPOINTING AUTHORITY - shall apply to the Board of
Commissioners for Deschutes County, Oregon.
CITY - shall apply to unincorporated areas of. Deschutes
County, Oregon, as hereinafter defined.
CITY TREASURY - shall apply to COUNTY TREASURY.
CITY RECORDER - shall apply to COUNTY CLERK.
BUILDING DEPARTMENT - shall apply to DESCHUTES COUNTY
BUILDING DEPARTMENT.
BUILDING OFFICIAL - shall apply to the official
designated by the County Commission as
the BUILDING ADMINISTRATOR.
MAYOR - shall apply to the COUNTY COMMISSIONERS.
FIRE CHIEF - shall apply to the CHIEF OF VOLUNTEER
FIRE DEPARTMENTS, Or Fire Departments of
Rural Fire Prevention Districts, or whichever
department shall have jurisdiction over the
area involved, or to his regularly appointed
deputy.
STREET - shall apply to streets as defined in the
Building Code, and to public roads of
Deschutes County, Oregon.
FARM LABOR CAMP - shall, apply to a shelter or temporary
housing for farm migrant or seasonal workers,
that is furnished without charge to the
occupants and is identifiable and subject to
control as a. faun labor camp within the
meaning of ORS 446.S1.0 (2).

MOBILE HOME- shall apply to a vehicular portable
structure built to the specifications and
standards of the United States of America
Standards for Mobile Homes (USASA 119.1, 1969
and as amended 1/6/74) on a chassis and designed
to be used without a permanent foundation as
a dwelling when connected to indicated utility
facilities. Each mobile home shall bear the
State plate certifying compliance with the
above standards.
MODULAR OR FACTORY -BUILT HOME - shall apply to a factory -
built dwelling unit designed to be transported
to a site and affixed to proper foundations and
the construction meets the standards of the
Oregon State Prefabricated Structures Code.
GENERAL PROVISIONS AND REQUIREMENTS. The Fire Marshall
Laws, as contained in O.R.S. Chapters 278, 407,
443, 478,479 and 480; O.R.S. 448.205 to 448.325
and regulations of the State Board of Health,
governing water supply; O.R.S. Chapter 835 and
regulations of the Department of Environmental
Quality, governing subsurface disposal of
sewage; the laws pertaining to electrical
wiring and equipment as contained in ORS
Chapters 479, 651 and 694 are incorporated in
and made a part of this Ordinance.
Flans for waste disposal facilities must have
the approval of the County Health Department
before a hermit is issued and the installed
facilities must be inspected and. approved
before back filling. No structure shall be
occupied until the facilities for water supply
and sewage disposal equal to the minimum
standards of the State Board of Health and the
Department of Environmental Quality have been
installed and are approved by the County Health
Department.
Building Permits or Mobile Home .Location Permits
shall not be issued if the parcel of land on
which the building is to be erected, or the
use of the building or land would. be in
violation of the Deschutes County Subdivision
or Zoning Codes.
Mobile homes are not to be located on a site
until a permit to locate a mobile home is
obtained.
TEMPORARY STRUCTURE; Buildings of a temporary nature
may be permitted if conditions of business
warrant such construction. A special permit
shall be granted, which permit shall be limited
to ninety(90) days with renewal of ninety(90)
days. The fee for the permit shall be five
dollars.($5.00).
BUILDING PERMIT AND PLANS REVIEW SCHEDULE
1. BUILDING PERMIT fees will be based on a fourteen (14) dollar per
square foot cost factor on residential building.
Exceptions: (a) Where a building has a contract price the contract
price will be the factor.
(b) Accessory Building permits will be assessed on the
basis of a four (4) dollar cost per square foot
factor.
Exception: Where the size of the accessory building
exceeds the area allowed for a "J" occupancy, the
charge will be based on the Oregon State plans review
schedule.
(c) Where the complexity of design or amenities indicate
a higher cost per foot should apply, an appropriate
cost factor will be established at the time of
application.
(d) Commercial Building permit fees will be based on the
architect's estimate or the bid price, whichever is
final.
(e) Where a basement is incorporated with a residence
a four (4) dollar per square foot valuation factor
shall be added to the permit fee for that portion
of the structure.
2. PLANS REVIEW fees will be based on thirty (30) percent of the building
permit fee.
3. SWIMMING POOLS fees shall be based on the schedule of fees as set forth
for residential building permits.
4. PUBLIC SCHOOLS fees for schools supported by taxes upon the general
public shall e 50% of the above rates.
5. APPROVED MODULAR HOMES fees for approved modular homes shall be 50%
of the above fees.

9. MECHANICAL PERMITS
The permit fees for the installation(in existing buildings) of
equipment or apparatus governed by the Mechanical Code shall be
based on actual value and be charged at the following fee
schedule:
$25.00 to $1,000
$5.00 for the first $500 plus $1.00 per additional $100
to and including $1,000.
$1,001 to $2,000
$10.00 for the first $1,000 plus $.50 per additional $100
to and including $2,000.
Over $2,000
$15.00 plus the same fee rate prescribed for buildings of
over $2,000 valuation.
