18-79-Order Recorded 4/24/1974IN THE BOARD OF COUNTY COMMISSIONERS OF THE STATE OF OREGON FOR THE COUNTY OF DESCHUTES In the Matter VOL 18 PACE 79 ) of ) O R D E R Vacation of Portion ) of Powell Butte-Paulina ) Creek Road 8 Sisemore Road ) This matter having come before the Commission on the 24th day of April, 1974, upon the petition of Brooks -Scanlon, Inc., Deschutes County, Oregon, requesting the vacation of portions of Powell Butte- Paulina Creek Road and Peter Zell County Road also known as Sisemore Road described to -wit: That portion of the Powell Butte-Paulina Creek Road lying in the Northeast one-quarter of Sec. 5, T. 18 S., R. 12 E., W.M. That portion of the Peter Zell County Road (also known as Sisemore Road) lying in the NW4 of Sec. 5, and the NEu of NEk of Sec. 6, all in T. 18S., R. 12 E., W.M., Deschutes County, Oregon, the centerline being more particularly described as: Beginning at the Center one-quarter corner of said Sec. 5; thence North 44 00' West 132.00 feet, more or less; thence North 24 00' West 231.00 feet, more or less; thence North 34 00' West 198.00 feet, more or less; thence North II 30' West 462.00 feet more or less; thence North 22 00' West 1122.00 feet, more or less; thence due West 1872.8 feet, more or less to a point on the West line of said Sec. 5; thence leaving said line due West 767.2 feet, more or less; thence North 29 00' West 420.7 feet, more or less, to a point on the South Boundary Line of the Plat of Enterprise Acres in the City of Bend, Oregon; said point being the terminus of this description, lying South 307.4 feet, more or less and East 1661.2 feet, more or less from the Nk corner of said Sec. 6. That there is on file and of record in the Deschutes County Clerk's office the approval of the said Deschutes County Board of Commissioners, in and to the said vacation as herein set forth, That there is also on file and of record the certificate of Dave Hoerning, Director of Public Works, swearing to the placing and posting of notice of the aforesaid vacation on three places within the limits of the area to be vacated, and a notice posted on each of the Bulletin Boards at the Deschutes County Courthouse and Annex. That the reasons have been set forth by the petitioner for the necessity of the vacation which has been petitioned, and it appear- ingto the Commission that the petition has been filed with the County Clerk for thirty days or more previous to the 24th day of April, 1974, and the Commission being fully advised in the premises, NOW THEREFORE, IT IS HEREBY ORDERED That the above described portions of County roads, located in Deschutes County, Oregon, shall be and the same is hereby vacated, as there were no objections at such Hearing held Wednesday, April 24, 1974.
