Grubb, Oscar R. Martin, Pat Burton, Ilene Mathisen, Bob Baum and Ken Detroit were present at the morning session. IN THE MATTER OF FINE FOR LATE PURCHASE DOG LICENSE: At this time the Commission ordered that the Deschutes County Dog Control Officer is authorized to impose a fine in the amount of the dog license fee for late purchase of dog license in addition to the cost of the purchase of the license, to be effective April 1, 1974. IN THE MATTER OF AMENDMENTS TO ZONING ORDINANCES.: At this time the Commission, upon the recommendation of the Planning Commission who held a public hearing and unanimously recommended approval, ordered that amendments to Deschutes County Zoning Ordinance No. PL -5, Sec. 3.310 Uses Permitted_.Outright and Sec. 3.115 Conditional Uses Permitted be adopted and amendment to Deschutes County Zoning Ordinance No. PL -2, Sec. 1.030 Definitions be adopted. IN THE MATTER OF BICYCLE RACE ON CO. ROADS: At this time the Commission granted approval for certain County roads as shown on route map to be used for bicycle race scheduled for Saturday, April 20, 1974, in Redmond providing all rules and regulations of the County Road Department and Sheriff's Department are complied with. IN THE MATTER OF HEARING ON RATE INCREASE FOR DISPOSAL COMPANY: At this time the Commission held a public hearing, and beings there were no objections, approved proposal for rate increase for Central Oregon Disposal Company's refuse collection. This Order effective April 1, 1974. IN THE MATTER OF GRAZING LEASE FOR BUSSARD & LYCHE: At this time the Commission granted Deschutes County grazing lease to Bussard and Lyche for property described as: T. 14 S., R. That portion of Peter Zell County Road (also known as Sisemore Road) lying in the NW4 of Sec. 5 and NEJ NEk of Sec. 6, all in T. 18 S., R. 12 E., W.M., Deschutes County, Oregon, the centerline of aforesaid road more particularly described as: Beginning at the center one- quarter corner of said Sec. 5; thence N 44*001 West 132.00 feet, more or less; thence N 24*001 West 231.00 feet, more or less; thence N 34*001 West 198.00 feet, more or less, thence N 11*301 West 462.00 feet more or less; thence N 22*001 West 1122.00 feet, more or less; thence due West 1872.8 feet, more or less to a point on the West line of said Sec. 5; thence leaving said line due West 767.2 feet, more or less; thence N 29*001 West 420.7 feet, more or less to a point on the South boundary line of the Plat of Enterprise Acres In the City of Bend, Oregon; said point being theterminus of this description, lying South 307.4 feet, more or less and East 1661.2 feet, more or less from the North one-quarter corner of said Sec. 6. It is, therefore, ordered that copies of this Resolution, duly certified to as such by the County Clerk, shall be posted in three (3) places along the roads to be vacated, and that a copy of this Resolution be placed on the Bulletin Boards in the entrance of the Deschutes County Courthouse and Annex, Bend, Oregon, that Wednesday, April 24, 1974, at 10:00 a.m. Daylight Savings Time, at the County Courtroom, County Courthouse Annex, Bend, Oregon, be and the same is hereby fixed as the time and place for the hearing of objections, if any therebe, why said portions of the roads should not be vacated as portions of Deschutes County Road System. IN THE MATTER OF HEARING ON ESTABLISHMENT OF ROADS: The Commission, on March 20, 1974, held a Hearing on the establishment of DENNING DRIVE, BAYOU DRIVE AND FARGO LANE in DAVIS ADDITION, and beings there were no objections nor remonstrances, did Order and decree that DENNING DRIVE, BAYOU DRIVE AND FARGO LANE in the plat of DAVIS ADDITION be established as described in Resolutions dated February 6, 1974, as county roads in Deschutes County. The legal descriptions are given in the Commission Minutes dated February 6, 1974. IN THE MATTER OF TRANSFER OF FUNDS: At this time the Commission ordered the Deschutes County Treasurer to transfer $3,000.00 from the Dog License Fund to the Dog Control Pickup and Crematorium Reserve Fund according to the Budget for fiscal year 1973-74. IN THE MATTER OF AGREEMENT WITH PIKA: At this time the Commission entered into Agreement with Pika, Inc. per- mitting Pika, Inc. to delay for 90 days from March 8, 1974, the annual payment in the amount of $6,505.16 on Lands Time Purchase Agreement entered into on February 19, 1971. Pika, Inc. agrees to pay $1,000.00 in consideration of delay in payment. IN THE MATTER OF APPROPRIATIONS TRANSFERS WITHIN GENERAL FUND: At this time the Commission ordered that the following transfers of appropriations be made: $130.28 from District Court Materials and Services, Office Supplies (01-12-201) to District Court Personal Services, Extra Help (01-12-IOE) as extra help was needed for vacation replacement. $250.00 from Abundant Food Materials and Services, Office Supplies (01-01-201) to Abundant Food Personal Services, Stores Clerk (01-01-10C) as line item was underbudgeted. -4- .' VOL 17 mu 961 APPROPRIATIONS TRANSFERS WITHIN DOG LICENSE FUND.: At this time the Commission ordered that the following transfers of appropriations within the Dog License Fund be made: $348.00 from Dog License Fund Personal Services, Dog Control Officer (09-56-10A) and $252.04 from Hospital Insurance (09-56-10F) to Dog License Fund Unappropriated Balance (09-56-224) to reverse Transfers #7 and #47 which were made in error. $600.04 from Dog License Fund Materials and Services, Refunds and Adjust- ments (09-56-223) to Dog License Fund Personal Services Hospital Insurance (09-56-10F) in the amount of $252-04 and Dog Control Officer (09-56-10A) in the amount of $348.00 as increase was granted to Dog Control Officer after budget was prepared and insurance at budget time was only enough for Dog Control Officer and not dependents. $150.00 from Dog License Fund Materials and Services, Dog Tags and Supplies (09-56-221) to Dog License Fund Capital Outlay, Canopy -Equipment (09-56-301) as canopy is needed for new pickup. IN THE MATTER OF APPROPRIATIONS TRANSFER WITHIN LIBRARY FUND: At this time the Commission ordered that the following transfer of appropriations within the Library Fund be made: $48.00 from Library Materials and Services, Office Supplies (05-53-201) to Library Fund Materials and Services, Xerox Machine (05-53-241) as error was made in coding. IN THE MATTER OF APPROPRIATIONS TRANSFER WITHIN ROAD FUND: At this time the Commission ordered that the following transfer of appropriations within the Road Fund be made: $2,000.00 from Road Fund Asphalt and Aggregate (02-50-228) to Road Fund Participation to Cities (02-50-237) to increase fund of Participation to Cities. IN THE MATTER OF REFUNDS OF TAXES: At this time the Commission ordered F. C. Johnson on Circuit Court payroll as Court Reporter at $1,024-00 per month effective March 1, 1974. Placed Jeff Kern on Road payroll as Engineering Technician III at $884.00 per month effective March 1, 1974, as he has completed probationary period. Placed Robert Kirk on Road payroll as Engineering Technician I at $629.00 per month effective March 1, 1974, as he has completed probationary period. Terminated Archie Underwood from Road payroll effective March 15, 1974. Placed Susan Barnes on Library payroll as Library Assistant at $349.00 per month effective March 16, 1974.
