IN THE BOARD OF COUNTY COMMISSIONERS FOR DESCHUTES COUNTY, OREGON In the Matter of Establishing a ) Policy for the Expenditure of ) County Highway and Road Funds for ) the Maintenance and Development ) of Non - County Dedicated Roads ) Pursuant to Ch. 244, Or. Laws, ) 1973 (Enrolled HB 2737) for the ) Period Commencing October 5, 1973. ) RESOLUTION AND ORDER et 17 PAT 561 The above - entitled matter came on regularly before the Board at its meeting of November 21, 1973; and It appearing to the Board that Ch. 244, Or. Laws, 1973 (Enrolled HB 2737) provided a procedure for the expenditure of county highway and road funds on ded- icated roads which are not county roads thereby replacing a prohibition which here- tofore existed on such expenditures by Oregon Law; and It appearing to the Board that there exists in Deschutes County in excess of 900 miles of county roads; and It appearing to the Board that funds to maintain such roads have been seriously curtailed by the insufficiency of funds for road maintenance purposes at a desirable level; and It appearing to_ the .Board that the large mileage of roads dedicated and accepted for public use, but not accepted for county maintenance purposes in Deschutes County, necessitates the adoption of a policy establishing conditions for the expenditure of county highway and road funds on non - county dedicated roads; and It appearing to the Board that the Director of Public Works has recommended to this Board such a policy, which the Board desires to adopt at this time, and the Board being fully advised in the premises; it is, therefore RESOLVED AND ORDERED that, in addition to the provisions of Ch. 244, Or. Laws, 1973 (Enrolled HB 2737) that the following policy be, and hereby is, adopted with respect to the expenditure of county highway and road funds for dedicated, but non - county, roads in the unincorporated areas of Deschutes County, to wit: e: VOt PAGE Ie That the Board of County Commissioners hereby authorizes expenditures of • county highway and road funds on non- county dedicated roads by the Director of Public Works provided: 1. A proceeding to improve the subject road to applicable county road standards as outlined by Deschutes County Subdivision Ordinance adopted,and dated September 9, 1970, is undertaken pursuant to ORS 371.605 through 371.660; 2. The time for filing objections to suchirnprov'ement pursuant to ORS 371.630 has expired and the Board of County Commissioners has ordered the improvement to be made; 3. Such expenditures be made only for the purpose of temporarily re- ducing hazards on such roads until the same can be improved to applicable county road standards; and it is further RESOLVE I; D ORDERED that the aforesaid policy became effective this •ay of November, 1973.
