Guss as Commissioner of the Deschutes County Special Road District No. I for a three year term ending December 31, 1976. At this time the Commission appointed George Warrington to the Deschutes County Advertising Committee as a member representing the city of Bend. IN THE MATTER OF VACATION OF PUBLIC ROADS: At this time the Commission, on December 19, 1973, held a Hearing on its intention to vacate portions of ABBOT DRIVE, ABBOT CIRCLE, CENTER ROAD, BEAVER DRIVE and THEATER DRIVE, as described in the Commission minutes dated November 7, 1973. It is hereby ordered that these portions of public roads as described shall be and the same is hereby vacated as there were no objections at said Hearing. IN THE MATTER OF 1ACATION OF PLAT OF RIVER PARK 1: At this time the Commission, on December 19, 1973, held a Hearing on its intention to vacate a portion of the Plat of River Park I as described in the Commission minutes dated November 7, 1973. It is hereby ordered that this portion of the Plat of River Park I as described shall be and the same is hereby vacated as there were no objections at said Hearing. IN THE MATTER OF CLARIFYING THE INTENT OF STOP VALVES AT PLUMBING FIXTURES: At this time the Commission, upon recommendation of the Building Department, resolved that the purpose of the stop valves mentioned in Sec. 21-098 of the Oregon Plumbing Code are for the purpose of providing a convenient means to isolate a fixture valve for the purpose of maintenance to the fixture, and further ordered that said fixture stop valves shall be located at the wall or floor within the room where the fixture is located. IN THE MATTER OF VOL I 7PAGE 609 WRECKING YARD PERMIT: At this time the Commission approved a wrecking yard permit for Isaac T. Kirk to operate Tom's Garage and Auto Wrecking. IN THE MATTER OF ESTABLISHING REVISED FEE SCHEDULE FOR ZONING: At this time the Commission, authorized by the Deschutes County Zoning Ordinance, ordered that the following fee schedule be established with the applicant paying the appropriate fee: Zone Change Application - $50.00; Variance Application - $25.00; Conditional Use Application - $25.00; Site Development Plan: Minor Alteration of Building $10.00, New Development (small scale) - $50.00, New Development (large scale) $50.00 plus $10.00 per acre up to $100.00. IN THE MATTER OF ENFORCING NUISANCE ABATEMENT PROVISIONS OF CG -4: At this time the Commission, deeming it in the public interest to provide adequate enforcement of nuisances created by the display or indiscriminate placement of junk and other related nuisances, ordered that the Deschutes County Planning Director be responsible for administering the Nuisance Abatement portion of the Deschutes County Solid Waste Ordinance #CG -4. IN THE MATTER OF LANDS TIME PURCHASE AGREEMENT WITH AUSTIN-, BURROW & KENTON NELSON: At this time the Commission entered into Lands Time Purchase Agreement with Charles Austin, John Burrow and Kenton Nelson as Tenants in Common at 12 Glen Road Bend, Oregon, to sell the property described as SW4 NEI of Sec. 25, T. 17S., R. 12 E., W.M. (40 acres more or less). The buyer agreed to pay the County $1,800.00 in cash upon execution of agreement and the balance in 120 equal monthly payments of $196.56 including interest commencing on December 30, 1973; total amount due under this contract being $25,387.20. IN THE MATTER OF BID OPENING: At this time the Commission awarded bid on two sedans and four pickups to Bob Thomas Chevrolet -Cadillac who was low bidder with a total of $4,710.00 for two 1974 Vega sedans with snow tires on rear tires and a total of $10,456.00 for four 1974 LUV pickups with snow tires on four wheels, amounting to $15,166.00. IN THE MATTER OF APPROVING PROPERTY EXCHANGE WITH DESCHUTES NATIONAL FOREST: At this time the Commission issued Resolution approving the exchange of Deschutes County property described as SWj NWk, NW14 SW4, Sec. 1, T. 19S., R. 12 E., W.M. for the Deschutes National Forest property described as strip of land in Sec. 22, T. 17S., R. 12 E., W.M. that is 400 feet in width, the easterly side of which is the easterly side of the SE4 NEI and NEI SE14 of Sec. 22, the westerly side of which is a line parallel with the easterly side of the SE14 NEI and NEI SEk of Sec. 22 and 400 feet westerly therefrom, the northern boundary of said strip is the right-of-way for the North Unit Main Canal irrigation ditch and the southern line is the Butler Market Road; and portion of Sec. 23, T. 17S., R. 12 E., W.M. described as the portion of the Wf NWI of Sec. 23, T. 17S., R. 12 E., W.M. lying south of the right-of-way for the North Unit Main Canal irrigation d i t c h . IN THE MATTER OF UNEMPLOYMENT INSURANCE: At this time the Commission elected to reimburse the State Employment Division for benefits paid rather than to pay tax according to monthly payroll. IN THE MATTER OF AGREEMENT WITH STATE OF OREGON ON MINERAL STUDY: At this time the Commission entered into agreement with the State of Oregon through the Dept. of Geology and Mineral Industries concerning the study by the State of mineral resources of Deschutes County with special emphasis on sand, gravel and pumice deposits with the cost to be shared equally by both state and county and with the county share to be no more than $6,750.00. -5- IN THE MATTER OF LANDS TIME PURCHASE AGREEMENT WITH COATS: va 17 PACE At this time the Commission entered into Lands Time Purchase Agreement with Eric W. Coats, Bend, Oregon, to sell property described as SW!4 SE4, Sec. 15, Twp. 18 S., Range 13 E., W.M. (40 acres more or less). The buyer agreed to pay the County $900 in cash upon the execution of this agreement and the balance in 120 equal monthly payments of $98.28 including interest, commencing on December 30, 1973; total amount due under this contract being $12,693.60. At this time the Commission entered into Lands Time Purchase Agreement with Eric W. Coats, Bend, Oregon, to sell property described as SE4 SE4, Sec. 15, Twp. 18 S., Range 13 E., W.M. (40 acres more or less). The buyer agreed to pay the County $900 in cash upon the execution of this agreement and the balance in 120 equal monthly payments of $98.28 including interest, commencing on December 30, 1973; total amount due under this contract being $12,693.60. IN THE MATTER OF NOTICE OF HEARING: At this time the Commission received report of completion of the work on Quaring Road within Local Improvement District #3 with assessment roll and set date of hearing for objections to the assessments to be January 16, 1974, at 10:30 a.m. in the Commissioners' Conference Room, Deschutes County Courthouse Annex, Bend, Oregon. IN THE MATTER OF TRANSFER OF APPROPRIATIONS WITHIN THE GENERAL FUND: At this time the Commission ordered that the following transfers of appropriations within the General Fund be made: $180.00 from District Attorney Materials and Services Crime Investigation 01-11-220 to District Attorney Materials and Services Convention 01-11-205 as there was an unanticipated CLE Conference important for all attorneys. $150.00 from District Attorney Personal Services 01 -11 -IOC to District Attorney Materials and Services Professional Services 01-11-218 as extra secretarial help was needed during the holidays to be paid by warrant. IN THE MATTER OF PERSONNEL ACTION: At this time the Commission approved the following personnel action: Placed John William Bale on Solid Waste payroll as Caretaker at $175.00 per month effective December 22, 1973.
