IN THE MATTER OF
TRANSFER OF FUNDS:
At this time the Commission ordered the County Treasurer to transfer
$7,145.82 from the County Fair Fund to the General Fund for the Caretaker's
salary.
IN THE MATTER OF
EMPLOYING PLANNING ASSISTANT FOR COIC:
At this time the Commission, upon the petition of Central Oregon Inter-
governmental Council in accordance with COIC Minutes appointing Des. County as
employing agent for COIC, ordered the County Clerk to place Brent Lake on the
Planning Department payroll as Planning Assistant at $700.00 per month to be
paid out of "701" funds from COIC.
IN THE MATTER OF LEASE
ON COUNTY -OWNED LANDS:
At this time the Commission granted a grazing lease of 50 acres to
Laurie Smead for $10.00 per year on that portion of the W1 NWJ of Section 17,
Township 17 S., Range 13 E., W.M. lying north of the Powell Butte Highway.
IN THE MATTER OF CHANGE ORDERS
ON COURTHOUSE ANNEX ADDITION CONTRACT:
At this time the Commission approved change orders on Courthouse Annex
Addition contract, increasing the contract sum by $965.00 and $8,530.00 to
$180,366.54.
IN THE MATTER OF VACATION
OF PORTIONS OF 13th and 14th STREETS:
The Commission, on April 4, 1973, held a Hearing on its intention to
vacate a portion of 13th and 14th Streets as described in the Commission minutes
dated February 21, 1973. It is hereby ordered that the portions as described
shall be and the same is hereby vacated as there were no objections at said
hearing.
IN THE MATTER OF VACATION
OF PUBLIC ROAD:
At this time the Commission acting upon the petition of Sherman Wright,
Redmond, Oregon, resolved to vacate a public road, to -wit:
All that portion of Waterway Addition lying westerly of U.S. Highway 97
according to the official map and plat thereof on file and of record in the
office of the County Clerk.
It is, therefore, ordered that copies of this Resolution, duly certified
to as such by the County Clerk, shall be posted in three places along the road
to be vacated, and that a copy of this Resolution be placed on the Bulletin
Board in the entrance of the Deschutes County Courthouse, Bend, Oregon; that
Wednesday, May 16, 1973, at 10:00 a.m. Daylight Savings Time, at the County
Courtroom, County Courthouse, Bend, Oregon, be and the same is hereby fixed as
the time and place for the hearing of objections, if any therebe, why said sub-
division should not be vacated as portion of the Deschutes County Road System.
IN THE MATTER OF
DEED FROM SORENSON:
At this time the Commission accepted a Bargain and Sale Deed from S. W.
and Ella C. Sorenson to Deschutes County for the N. 30 feet and W. 30 feet of
the NE$ NEk of Sec. 24, T. 17 S., Range 14 E., W.M., subject to the condition
that the property be used for future road purposes.
IN THE MATTER OF AMENDMENTS TO
DES. CO. ZONING ORDINANCE #PL -5:
At this time the Commission, upon the petition of the Planning Commission
and the recommended approval of those present at public hearing, ordered the
amendments to Des. Co. Zoning Ordinance, #PL -5, allowing Sand and Gravel
operations as a Conditional Use in A-1 Zone, be adopted.

IN THE MATTER OF RESOLUTIONS TO VOL 16 PACE656
ESTABLISH COUNTY ROADS:
At this time the Commission made Resolutions of its intention to establish
county roads in Deschutes County, Oregon, described as follows:
THIRTEENTH STREET - A strip of land for street purposes 60 feet in width, 30 feet
each side of centerline as platted on the official plat of North Rim as recorded
in the office of the County Clerk.
ELEVENTH STREET - A strip of land for street purposes 60 feet in width, 30 feet
each side of centerline as platted on the official plat of North Rim as recorded
in the office of the County Clerk.
TWELFTH STREET - A strip of land for street purposes 60 feet in width, 30 feet
each side of centerline as platted on the official plat of North Rim as recorded
in the office of the County Clerk.
POPLAR AVENUE - A strip of land for street purposes 60 feet in width, 30 feet
each side of centerline as platted on the official plat of North Rim as recorded
in the office of the County Clerk.
NORTH CANYON DRIVE - A strip of land for street purposes 60 feet in width, 30 feet
each side of centerline as platted on the official plat of North Rim as recorded
in the office of the County Clerk.
And it is Ordered that the Co. Roadmaster or his duly qualified deputy shall give
notice of these Resolutions by posting true copies thereof, property certified
to as such by the Co. Clerk, at the place of holding Co. Court and also at three
public places in the vicinity of said proposed roads 30 days previous to the
consideration of these Resolutions by the Board of Commissioners notifying all
persons concerned that said Resolutions will be considered and passed upon by
this Board at a meeting on the 16th of May, 1973, at which time the Board will
consider any objections or remonstrances which may be filed on account of said
proposed roads.

NOTICE OF PUBLIC HEARING:
At this time the Commission gave notice of Public Hearing to be held at
10:00 a.m. on May 4, 1973, in the Commissioners' Office of the Deschutes Co.
Courthouse, on petition of the District Board of the Cloverdale Rural Fire
District to annex certain territory described as follows:

IN THE MATTER OF
OVEREXPENDITURE OF BUDGET:
At this time the Commission approved an overexpenditure of budget for
the Juvenile Department in the amount of $750.00 for foster care and youth care
centers.
At this time the Commission approved overexpenditures of budget for the
District Court in the amount of $300.00 to pay for necessary office supplies
for the balance of the fiscal year and in the amount of $2,000.00 to finance
jury trials for the remainder of the fiscal year.
IN THE MATTER OF THE PROPOSED FORMATION
OF TALL PINES SPECIAL ROAD DISTRICT:
This matter coming before the Board of Commissioners by the petition of
more than 25% of the persons who, according to the latest assessment role, hold
title to land within the proposed special road district (description in attached
Order), said petitioners asking that a special road district be established under
the provisions of QRS Sections 371.305 through 371.385. It being the intention
of the Board of Commissioners to organize the described territory into a special
road district named, Tall Pines Special Road District. It is ordered that a
Hearing be held on the matter of such proposed formation on Thursday, May 10,
1973 at 10:00 a.m., Deschutes County Courthouse.

RESOLUTION ON HB #2463:
At this time the Commission rescinded Resolution on House Bill #2463 as
explained in Commission Minutes dated March 21, 1973, and approved Resolution
on House Bill #2463 as submitted by Des. Co. Planning Commission Chatrman
Mathew Perlot, approving the bill as it provides flexibility for intergovernmental
cooperative arrangements, but omitting example in Section 2.
I N THE MATTER OF
AGREEMENT WITH AUDITOR:
At this time the Commission entered into Agreement with Marvin E. Walpole,
Certified Public Accountant, to conduct an audit for period beginning July I,
1973, to June 30, 1974, and annually thereafter in accordance with prescribed
minimum standards of audit, reports, certificates and procedures.
IN THE MATTER OF
SPECIAL ELECTIONS:
At this time the Commission upon recommendation of the Solid Waste Advisory
Committee ordered that a special election be held to permit a levy for the
financing of Solid Waste Disposal Sites in Deschutes County on May 7, 1973.
Said levy will be outside the limitation imposed by Article XI, Section 11, of
the Oregon Constitution, in the fiscal year beginning July 1, 1973, In the
amount of $112,000.00 for a period of one year. The maximum rate of levy shall
be 28 cents per thousand dollars of true cash value of taxable property. Such
funds are to be expended for the continued maintenance of the public solid waste
disposal sites presently existing in Deschutes County.
At this time the Commission ordered that a special election be held to
permit a levy for the financing of the Deschutes County Public Library on
May 7, 1973. Said levy will be outside the limitation imposed by Article XI,
Section 11, of the Oregon Constitution, in the fiscal year beginning July I, 1973,
in the amount of $112,874.00, for a period of one year. The maximum rate of

At this time the Commission approved the following personnel action:
Placed James R. Rasmussen on the Planning Department payroll at $599 per
