16-280-Order Recorded 12/6/1972VOL 16 PACE 28 IN THE BOARD OF COUNTY COMMISSIONERS OF THE STATE OF OREGON FOR THE COUNTY OF DESCHUTES In the Matter of ) ORDER Bend Urban Area ) Zoning. ) This matter coming before the County Commission upon the Planning Commission's petition who held a public hearing on this issue November 29, 1972 and recommended it's approval, and, The County Commission deeming this action to be in public interest and the County Commission being advised, and, Pursuant to Oregon Revised Statutes 215 requiring zoning regulations to be established in counties, and, Pursuant to County Zoning Ordinance PL -5, IT IS HEREBY ORDERED That the official Zoning Map #ZM-2 with zones shown be adopted -zoning those areas within the confines of the following legal description: The area to be zoned is all that area between the city limits of the City of Bend and the Urban Growth boundary as established by the City of Bend and Deschutes County. The Urban Growth Policy boundary is generally defined by Hamby Road on the East, Rickard Road on the South, the Deschutes National Forest on the West and Butler Market and Cooley Roads on the North. The area to be zoned also includes all that property lying North of Shevlin Park, West of the Deschutes River, East of the Deschutes National Forest Eastern boundary and South of the established 1990 Bend Comprehensive Planning Boundary. IT IS ORDERED THAT zone change requests effecting this order shall not be reviewed by this Commission for a period of approximately seven months, VOL 16 FADE 281 said time period concluding on July 25th, 1973, unless otherwise initiated by the County. IT IS FURTHER ORDERED That the policies adopted by the Planning Commission in conjunction with subject zoning are hereby ratified; Finally, It is Ordered that all B. L. M. and other publicly owned lands sold or exchanged for private use shall assume the same zoning as those established on contiguous properties. In the case where more than one zone exists on contiguous land, the most restrictive zone shall apply. Done by order of the Commission this 6th day of December, 1972. COMMISSIONER
