R E S O L T I O N

Be It Remembered, that at a term of the Board of County Commissioners, be-
gun and held at the County Courthouse in Bend, in said County on Wednesday, May 3,
1972, the same being a term of said Board of County Commissioners sitting for the
transaction of County Business, and at which time said Board of County Commissioners
may, by Resolution, exchange land under an agreement with the State of Oregon, the .
following among other proceedings was had, to -wit:
WHEREAS, Pursuant to ORS 366.300(3), State and County may enter into agree-
ments for the disposition of sections of any state highway right-of-way that may be
eliminated from the original route by reason of relocation or realignment of the high-
way where the sections to be eliminated are needed for the service of persons living
thereon or for a community served thereby; and
WHEREAS, due to the relocation of the Deschutes River (Tumalo) Bridge Sec-
tion of a Deschutes County Road, FAS No. 946, a portion of the right -of -way of the
former route is no longer needed for County purposes and may be eliminated, which
portion to be eliminated is hereinafter designated as Unit "B" and "C" and are shown
colored in blue and orange on the map attached hereto, marked "Exhibit A" and by this
reference made a part hereof; and
WHEREAS, Deschutes County and the State Highway Commission entered into an
agreement on October 19, 1971, relating to the elimination and disposition to be made
of Unit B and Unit C
WHEREAS, said agreement provides that the Board of County Commissioners shall,
by resolution, formally eliminate County's interest, if any there be, in Units B and C;
that all right, title and interest of Deschutes County in the units shall thereupon
pass to and vest in the State of Oregon; and that the State of Oregon shall accept all
right, title and interest of the Deschutes County in the units, in exchange for any in-
terest that State may have in Unit A, approximately as shown colored in red on Exhibit
A.
NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by this Board of Commis-
sioners as follows:
1. That by reason of the relocation and construction of the Deschutes River
(Tumalo) Bridge Section of a Deschutes County Road, FAS 946, in Deschutes County, Ore-
gon, a portion of the right -of -way of the former . route is no longer needed by Deschutes
County, which portions of the right -of -way are identified as Units B and C and are
described as follows:

UNIT B
All that portion of former right -of -way lying outside the
right -or -way of said relocated section approximately oppo-
site relocated Engineer's Station 53 +00 to 55 +78.50 P.T.
westerly of the relocated Deschutes River (Tumalo) Bridge
Section except that portion needed for a county road con-
nection, situated in Section 6, T 17 S, R 12 E, W.M.,
Deschutes County, Oregon.
UNIT C
All that portion of former right -of -way of said relocated
section lying easterly approximately opposite relocated
Engineer's Station 57 +00 and 59 +00, situated in Section 6,T

2. That under the agreement entered into by the State Highway Commission
and Deschutes County on October 19, 1971, Units B and C, as heretofore described
and as shown colored in blue and orange on Exhibit A, are hereby duly eliminated
as a portion of the former route, and all right, title and interest of Deschutes
County in Units B and C hereby pass to and vest in the State of Oregon.
3. That this resolution be entered in full the minutes and records
of Deschutes County as Resolution Nti. this day of
1972, and the Clerk is ordered to mail a duplicate copy hereof to t to of
Oregon.
