15-235-Order Recorded 1/5/1972VOL 5 PACF ?,e l IN THE BOARD OF COUNTY COMMISSIONERS OF THE STATE OF OREGON FOR THE COUNTY OF DESCHUTES In the Matter ) of ) O R D E R Easement for Transmission ) Lines Right -of -Way ) This matter coming before the Board of Commissioners upon the petition of Pacific Power and Light Company, a corpora- tion, asking an easement to install transmission lines over county -owned lands, and, The Board having made investigation and being advised, finds as follows: That it is necessary for the Pacific Power and Light Company, a corporation, to construct and maintain a transmission line across county lands, and is hereby granted a 99 -year ease- ment across Deschutes County owned lands as follows: In Township 17 South, Range 12 E.,W.M. A strip of land 110 feet in width, paralleling to, and joining the P.P.&L. transmission line on the West thru the Wj of the NEµ of Section 24 and the SWµ of the SEµ of Section 24 and thru the Wj of the NEµ of Section 25. A strip of land 27 feet in width adjoining and parallel to the South right-of-way line of the Butler Market Rd. 930 feet in length easterly from the NW corner of the NWµ of the NEµ of Section 24. See exhibt A - attached, and made a part hereof. Together with the right of ingress and egress over the adjacent land of the Grantor for the purpose of constructing, reconstructing, stringing new wires on, maintaining and removing such line and appurtenances, and exercising other rights hereby granted. The Grantee shall pay to the Grantor reasonable compen- sation for any damage caused by Grantee, or its agents, to any property or crops (growing or to be grown) on the above described real property, arising out of the construction, reconstruction, operation and maintenance of said transmission and distribution line. At no time shall any building or anything flammable be erected or placed within the boundaries of said right-of-way, nor shall any equipment or material of any kind or nature that exceeds 20' feet in height be placed or used thereon by Grantor or its successors or assigns. Page I of 2 vol 15 P6(;r 236 SUBJECT to the foregoing limitations, said right-of- way may be used by the Grantor for roads, agriculture crops, or any purpose not inconsistent with said easement. I 4 cmaurCa Aa eaeols i ' VOL 15 ?AcF 237 RIGHT OF WAY EASEMENT VOL 15 FAA ,JI -18 The undersigned, Grantor, in consideration of $4,758.33 and other valuable consideration, hereby grants to PACIFIC POWER & LIGHT COMPANY, a corporation, its successors and assigns, Grantee, an easement for a right of way 110 feet in width for electric transmission and distribution lines of one or more wires and all necessary or desirable appurtenances, including telephone and telegraph wires, towers, poles, props, guys and other supports, along the general course now located by Grantee over the following described real property located in Deschutes County, State of Oregon , to wit: Township 17 South, Range 12 E.,W.M. A strip of land 110 feet in width, paralleling to, and joining the P.P.$L. transmission line on the West thru the WZ of the NEu of Section 24 and the SWk of the SE4 of Section 24 and thru the W1 of the NE4 of Section 25. as more particularly described on attached Exhibits) A by this reference made a part hereof. The within grant shall include: the right to place all or any part of such lines under- ground; the right to install and maintain guys and anchors outside said right of way; the right to clear said right of way and keep the same clear of brush, trees, timber and structures; the present and future right to clear and cut away all trees outside of said right of way which might endanger said transmission lines; the right to construct, reconstruct, operate, maintain, replace, enlarge, repair and remove any of said facili- ties; the right in the future to construct, reconstruct, operate, maintain and remove additional lines, wires and all necessary or desirable poles, structures and appurtenances thereto; and the right of ingress and egress over adjacent lands of Grantor for all said purposes. Grantee shall pay to Grantor reasonable compensation for any damage caused by Grantee to any property or crops on the above described real property arising out of the use thereof by Grantee. At no time shall any flammable material or any building of any kind be placed or erected within the boundaries of said right of way, nor shall any equipment or mater- ial of any kind that exceeds 20 feet in height be placed or used thereon by Grantor or by Grantor's heirs, successors or assigns.
