Woodward and Catherine R. Woodward. During the discussion, Commissioner G. W. McCann noted that the published copy of the Exchange stated: "Deschutes County would deed to M. L. Woodward, Lot 3, Section 31, Twp. 14 S., R. 13 E., W.M., PLUS county road right-of-way." The word PLUS should have been the word LESS. And so the Deeds were ordered to be executed, beings there were no objections to the trade and then another Deed was prepared and executed stating: Melferd L. Woodward and Catherine R. Woodward, husband and wife, deeded to Deschutes County "All that portion of Ivancovich Road, sixty feet in width, going through Lot 3, of Section 31, Township 14 South, Range 13 East, Willa- mette Meridian, Deschutes County, State of Oregon. All Deed executed by M. L. Woodward and Deschutes County were recorded with the Clerk, Helen M. Dacey, on August 19, 1970. IN THE MATTER OF BID OPENING: At this time Clerk Helen M. Dacey opened the sealed bids for Herbicides. The bids were awarded to the following: For Banvel, to Van Waters & Rogers Co whose bid was $21.17 per gallon; for Dacagin, to Wilbur -Ellis Co., whose bid was $1.33 per pound. The Weed Supervisor, Harry [pock, was to notify the successful bidders. -3- IN THE MATTER OF MOVING A COUNTY OWNED HOUSE AT 145 E. PENN• ✓OL 14 PA IT Y/q At this time the Board authorized Gerald L. Hastings to move a county - owned house, from county -owned land, located at 145 Penn Avenue, Bend, Oregon. In consideration of same, the mover is to have the house as payment for re- moving it from county property. IN THE MATTER OF SIDEWALK CONSTRUCTION: The Commission at this time granted permission to Roadmaster Charles L. Plummer, to have Robert Wilson construct a sidewalk on the south side of Kansas Avenue, approximately 150 feet long by 5 feet wide. The cost would be $ .56 per sq. ft. or approximately $450.00. This price includes all materials and labor. IN THE MATTER OF ATTENDANCE AT SESSION: Those attending the Commission session were: Mr. Christy, Charles L. Plummer, John Sullivan and Kurt Englestad. IN THE MATTER OF AGREEMENT WITH INDIAN FORD RANCH: At this time time an agreement was made in which Indian Ford Land and Cattle Company agrees to release the Board of Commissioners and Deschutes County from all responsibility and to hold it harmless from all cl:ilrbs by Indian Ford Land and Cattle Company, in consideration of the County's agree- ment to pay Indian Ford Land and Cattle Co. 150 per cubic yard, to a maximum of 3500 cubic yards, for cinders Indian Ford Land and Cattle Co. will push up from the Cyrus cinder pit near Sisters: 1. The removal of trees from land owned by Indian Ford Land and Cattle Co. in connection with the clearing and widening of Wilt Road in 1969;and 2. The removal of gravel by the County in the past from the gravel pit owned by Indian Ford Land and Cattle Company. IN THE MATTER OF MEMORANDUM OF AGREEMENT: At this time an Agreement between Deschutes County and Millie Chopp was entered into for cleaning of all the offices in the Department of Public Works Building at 1507 East First Street, Bend, Oregon. This agreement is to run from July 1, 1970 to June 30, 1971 unless cancelled or modified by the parties concerned, in which it may be terminated by either party upon thirty (30) days written notice to the other party. For the work performed the County shall pay the Contractor $348.00 per month. IN THE MATTER OF EXECUTION OF DEED: The Commission executed a Deed to H. J. Curl, Jr., conveying the follow- ing described real property, located in Deschutes County, Oregon; to -wit: Lots Seven (7), Eight (8), Nine (9), Ten (10), Eleven (11) and Twelve (12), Block Thirty-five (35), LAIDLAW The consideration for this transfer is the exchange of other property in Block Thirty-five, Laidlaw, Deschutes County, Oregon. -4- IN THE MATTER OF LEASE OF COUNTY OWNED LANDS.: VOL 14- FADE 80 The Commission at this time signed a Lease Agreement whereby leasing the following described county -owned lands to Double R. & C Ranch, Terrebonne: Twp. 14 S., R. 11 E., W.M.: Sec. 24: SEyNWg, SZNEZ Twp. 15 S., R. 11-E., W.M.: Sec. 1: NEkNW#, WZNW$, NWkNEk 2: NZNEs, SEkNEj, SZNW4 3: SWjNEj, NWkSE4, SWZSEu, SZSEkSEk Two. 14 S.. R. 12 E., W.M.: Sec. 29: WZNW$, SE*SW4 & part SWiSE$, W. of Lower Bridge Market Road 30: SZNEZ, WZSW4- 31: NEJNEk, SZNEk, NWZ, NZSWZ, NZSEk, SE$SEr 32: Part NZSW4, West of Lower Bridge Mkt.Rd. containing 1,439.55 acres, more or less. The term of this lease is from January 1, 1970 to December 31, 1970, for grazing purposes at the rate of 10 cents per acre or $143.95. IN THE MATTER OF INSTALLING BURIED CABLE: The Commission at this time granted permits to Pacific Northwest Bell for the following: Buried Cable on Pettigrew Road (Permit #77900), crossing county road Paralleling or crossing county road (Permit #77889) Buried Cable in Whispering Pines Estates Subdiv. (#77903) IN THE MATTER OF ACCESS: At this time the Commission granted a permit to Kenneth J. & Edith Greene to install an access. IN THE MATTER OF BURIED CABLE: At this time the Commission granted a permit to United Telephone Co. of the Northwest to construct buried able on Goodrich Loop & Cloverdale Roads. IN THE MATTER OF ACCESS: The Commission at this time granted a permit to Howard Clark to install an access on or across Deschutes County right-of-way. IN THE MATTER OF MOVING A BUILDING: The Commission at this time granted a permit to K. J. Holman to move a building from 145 E. Penn to Swedes Auction via Hwy. 97 to Anderson Road to Auction yard. IN THE MATTER OF REFUND OF TAXES: The Commission at this time ordered F. C. Sholes, Tax Collector, to make the following refund of taxes: U.S. Nati.
