ORDINANCE NO. PL - 6
AN ORDINANCE AMENDING ARTICLE I, SECTION 109 AND ARTICLE 5, SECTION 501 OF
THE DESCHUTES COUNTY SUBDIVISION ORDINANCE NO. PL -2, PROVIDING FOR DEFINITIONS,
FILING PROCEDURES AND AUTHORITY TO ESTABLISH SUBDIVISION FILING FEES.
THE BOARD OF COMMISSIONERS, COUNTY OF DESCHUTES, DOES ORDAIN AS FOLLOWS:
SECTION 109C. DEFINITIONS (Amending sub -section 25.)
25. SUBDIVIDE LAND. --"Subdivide Land" means to partition a parcel of land
into four or more parcels, any one of which is less than ten (10) acres,
for the purpose of transfer of ownership or building development, whether
immediate or future, pursuant to O.R.S. 92.010.
SECTION 501. FILING PROCEDURE (Amending sub -section B. and adding sub -section
D. and E.)
B. The time of filing the preliminary plat shall be construed to be the time when
the preliminary plat is filed with and officially received by the County Planning
Department, and such fees as set pursuant to paragraph (D) of this section
have been paid, but in no event less than twenty one (21) working days before
the next regularly scheduled meeting of the Planning Commission.
D. The Board of County Commissioners may set, by resolution, fees to be paid by
the subdivider to the Deschutes County Planning Director at the time of filing
of the preliminary plat, of an amount sufficient to cover all or part of the
cost of services provided by the Deschutes County Planning Commission and the
Deschutes County Planning Department in connection with the proposed subdivision.
E. Preliminary plats shall be filed at least twenty one (21) working days prior
to a regularly scheduled meeting of the Planning Commission in order to have
the preliminary plat considered at that meeting.
Adopted by order of the Deschutes County Board of Commissioners this 25th day
of August, 1971 and to become effective on September I, 1971.
