This matter coming before the Commission upon the
petition of SUNRIVER PROPERTIES, INC., an Oregon corporation,
through its President, Donald V. McCallum, praying for the
vacation of a portion of Plat of Forest Park I, in Sunriver, as
recorded and on file in the Deschutes County Clerk's office
to -wit:
Tract No. 1: A portion of FOREST PARK I,
Sunriver, Oregon, located in Section 5, Town-
ship 20 South, Range 11 East, W. M., Deschutes
County, Oregon, more particularly described as
follows:
Beginning at a point whence the Northeast
Corner of said Section 5 bears North 45 deg.
56' 04" East, 2329.31 feet; thence South
83 deg. 48' 29" East, 200.00 feet; thence
South 67 deg. 40' 50" West, 245.10 feet; thence
North 13 deg. 40' 42" East, 118.00 feet to the
point of beginning.
Tract No. 2: Beginning at a point whence a 2"
Iron Pipe at the Northwest corner of Section 5,
Township 20 South, Range 11 East, W.M., the
initial point, bears North 42 deg. 42' 04"
East, 3041.40 feet; thence North 71 deg. 56' 22"
West, 121.34 feet; thence around a 530.00 foot
radius curve left, 107.03 feet, long chord bears
North 77 deg. 43' 28" West, 106.85 feet; thence
North 83 deg. 30' 35" West, 57.49 feet; thence
around a 470 foot radius curve right, 94.91 feet,
long chord bears North 77 deg. 43' 28" West,
94.75 feet; thence North 71 deg. 56' 22" West,
202.90 feet; thence South 17 deg. 00' 01" West
141.73 feet; thence South 72 deg. 59' 59" East,
60.00 feet; thence North 17 deg. 00' 01" East,
80.62 feet; thence South 71 deg. 56' 22" East,
141.78 feet; thence around a 530 foot radius
curve left, 107.03 feet, long chord bears South
77 deg. 43' 28" East, 106.85 feet; thence South

a 470 foot radius curve right, 94.91 feet, long
chord bears South 77 deg. 43' 28" East, 94.75 feet;

the point of beginning.

The Commission having been advised and upon investiga-
tion find that the above described portion of Forest Park 1, which
on the recorded plat thereof is designated as being within the
"common" area of said Addition, is in fact situated partially within
the common area of Forest Park II, a projected plat of Sunriver
Properties, Inc., and partially within the area of said Forest Park 11
which is projected to be subdivided and platted as Tots in said plat;
that the acreage which is being devoted to "common" area within said
Forest Park II is in excess of the acreage of that above described
property which petitioner wishes to vacate; that Tract No. 2 herein
described is labelled "private way" upon the plat of Forest Park 1;
that the same does not conform to the private way which currently
exists and is being used for access from Abbot Drive to said plat
known as Forest Park 1 and that the plat of Forest Park 11 will cor-
rectly label and designate the same; that the conformation of both
Forest Park I and Forest Park II will be improved by the vacation of
said above described property and its inclusion within the plat of
Forest Park II will not adversely affect the rights of any persons or
parties to be affected thereby and will, in fact, enhance them; that
the vacation of said above described parcel and its inclusion within
the plat of Forest Park 1I will favor the economic installation of
roads and utilities in both the plats of Forest Park 1 and Forest Park I1.
The only persons, firm and /or corporation to be particularly
affected by said vacation is Sunriver Properties, Inc., sole owner,
in fee simple of all of the above described property.
None of the above described property to be vacated adjoins
or abutts any road, highway, street or alley, or any portion thereof.
IT IS THEREFORE RESOLVED That there be a vacation of the
above described Tract No. 1 and Tract No. 2, a portion of Forest Park I
as recorded in the plat filed in the Deschutes County Clerk's office.
And it is further ordered that Donald V. McCallum of Sunriver,
post notices of the proposed vacation in three (3) conspicuous places
and that the date of Hearing shall be May 6, 1970, at 10:00 a.m.,
Pacific Daylight Time, in the Deschutes County Courtroom, Deschutes
County Courthouse, Bend, Oregon.
