Fairchild Livestock indemnity 67.20 -3- IN THE MATTER OF HEALTH DEPARTMENT PERSONNEL: The Court at this time ordered the Deschutes County Clerk to place the name of Dr. W. E. Dickey, Jr. on the payroll in the Health Department, effective November 1, 1969, at a salary of $250.00 per month as Medical Investigator; also Dr. J. P. Howebert, M.D. and Dr. George McGeary will handle the autopsies. IN THE MATTER OF STATE WELFARE FUNDS: The Court at this time approved the transfer of $400.00 from General Fund to State Welfare Funds for staff development funds as it was budgeted in 1969-70 budget. IN THE MATTER OF AGREEMENT: The Court at this time entered into an Agreement with Fred Ramsey and Mae Ramsey for the purpose of purchasing cinders for use on Wilt Road; the approximate quantities involved are 8,000 cubic yards at the rate of .10 per cubic yard. Deschutes County agrees to maintain the pit in an orderly fashion and compatible to Mr. Ramsey, said pit located in Sec. 24, T. 14 S., Range 10 E.W.M. IN THE MATTER OF REPRESENTATIVE TO CENTRAL OREGON COUNCIL OF GOVERNMENTS: The Court in regular session, designated Commissioner G. W. McCann as the representative of the Court to the Central Oregon Council of Governments. IN THE MATTER OF DEDICATION OF PUBLIC WAY: At this time the Court ordered that the South 33 feet of SE 1/4 SW 1/4 Section 16, Township 15 S., Range 13 E.W.M. be and hereby designated as a public way. IN THE MATTER OF BID OPENING: The Court, on October 17, 1969, at 10:00 a.m. in the Deschutes County Courtroom ordered the Clerk of the Court to open sealed bids for Asphaltic Concrete Paving. Two bids were read: Robert Coats, $980.00 per T, with a total of $24,500.00 and Bend Aggregate & Paving, $979.00 per T., with a total of $24,475.00. The contract was awarded to H. J. Curl of Bend Aggregate and Paving Co. Said contract was made in triplicate between Deschutes County and Bend Aggregate & Paving for the Asphaltic Concrete Paving on Studio Road. IN THE MATTER OF AN AGREEMENT: The Court entered into an agreement between Deschutes County Road Department and Lloyd Mathers setting a price for the drilling of drain holes on Studio. The agreed price will be $100.00 for the set up and the first twenty five (25) feet, and $3.00 per foot additional beyond that depth. IN THE MATTER OF INSTALLING A PRIVATE SIGN ON COUNTY RIGHT OF WAY: The Court authorized Mrs. Henry Moulton to install a sign on Deschutes County right-of-way, located on Wilt Road at its intersection with Camp Polk Road. -4- VOL 13 PACE , 3 7N THE MATTER OF VACATION OF A STREET IN LAIDLAW: The Court, on October 22nd, held a Hearing and beings there were no objections, did hereby order that the portion of Riverside Avenue in Laidlaw Deshutes County, Oregon shall be and the same is hereby vacated, namely: The west fifty (50) feet of Riverside Avenue from the extended south line of Block 12 to the south line of the Nichols Secondary Road of Laidlaw. IN THE MATTER OF WATER QUALITY AND WASTE TREATMENT STANDARDS FOR DESCHUTES RIVER BASIN: The Court upon the reading of Water Quality and Waste Treatment Standards for Deschutes River Basin, a report released by the Department of Environmental Quality, State of Oregon in October, 1969, did hereby resolve that the Deschutes County Court is opposed to the disposal of any waste in the Deschutes River or its tributaries. IN THE MATTER OF AGREEMENT WITH LAVA BUTTE TV CABLE & COMMUNICATIONS, INC.: The Court at this time entered into an Agreement with Lava Butte TV Cable and Communications, Inc., and Deschutes County whereby the County leased the following described property: A tract of land in the NW 1/4 of the NE 1/4 of Section 30, Township 17 South, Range 12 East of the Willamette Meridian described as follows: Beginning at a point which bears S 310 40' 20" East 1122.37 feet from the North 1/4 corner of said Section 30; thence North 810 22' East 108.00 feet; thence North 080 38' West 75.00 feet; thence South 81 22' West 100.00 feet; thence South 080 38' East 75.00 feet to the point of beginning. Said tract containing 0.17 acres more or less. Said property is for the purpose of installation of equipment for reception and transmission of television and/or radio signals; the lessee is to pay the County Fifty Dollars (50.00) annually for each transmitter in operation on the above site, beginning October 16, 1969. Said contract is subject to annual renewal from this date. IN THE MATTER OF ESTABLISHING POLICY FOR SALE OF COUNTY LANDS: The Court at this time ordered the establishment of Policy for sale of county lands by written agreement for installment payments with regard to the maximum years for such payments, the interest rate and schedules. IN THE MATTER OF COOPERATIVE AGREEMENT: At this time the Court entered into a new cooperative agreement with U.S. Department of Agriculture, Forest Service, Region 6,which supersedes the agreement dated May 16, 1966; the changes incorporate the furnishing of cost estimates and a supplement to the basic agreement for each project. -5- J VOL 13 PACE 339 IN THE MATTER OF PERSONNEL IN HEALTH DEPARTMENT: On October 27, 1969, the Court made a Correction Order in placing the name of Dr. Wa: E. Dickey, Jr. on the payroll as Medical Investigator for Deschutes County only; and correcting the Order made on the 15th day of October, 1969. IN THE MATTER OF RESALE OF COUNTY - OWNED PROPERTY: The Court, at this time ordered the Sheriff to be authorized and directed to sell the following described real property in the manner pro- vided by law for not less than the minimum price set opposite each tract, plus cost of advertising and recording the deed: Parcel 1: The south 420 feet of east 520 feet of SE*NE# $ 726.25 Sec. 14, Township 17 South, Range 12 E.W.M., Terms: tying north of Hamehook Road (4.15 acres, 20% down, more or less) Balance in 3 years, in equal monthly payments at 8% interest Parcel 2: That part of the SEkNEk Sec. 14, Twp. 17 S. $1,235.50 R. 12 E.W.M., lying north of the Hamehook Road Terms: and east of the C01 Lateral, (except the south 20% down, 420 feet of east 520 feet --which is parcel #1), Balance in consisting of 7.06 acres, more or less, and 3 years, in subject to reserving to the U.S. of America equal monthly from these lands a right-of-way thereon for payments at ditches orcanals constructed by the authority 8% interest of the U.S. Act of August 30, 1890, 26 Stat. 391; 43 U.S.C. 945. IN THE MATTER OF REFUND OF TAXES: The Court at this time ordered F. C. Sholes, Tax Collector, to make the following refund of taxes: John J. Bragg Arthur G. Keast IN THE MATTER OF DEPUTY DISTRICT ATTORNEY: Double payment $18.91 Paid on wrong property $17.05 The Court at this time ordered the Clerk to place the name of Allison E. Smith, Deputy District Attorney for Deschutes County, on a full time basis at an annual salary of $9,300.00, effective November I, 1969. IN THE MATTER OF MOVING A BUILDING: The Court at this time granted a permit to K. J. Holman to move a 36' x 22J1x27' building on or across Deschutes County right-of-way. IN THE MATTER OF AN ACCESS: The Court at this time granted a permit to R. A. Brownrigg to construct an access on or across Deschutes County right-of-way. IN THE MATTER OF BEER LICENSES: The Court at this time approved the following renewal applications for beer licenses; Keast, Arthur G. & Anne Melkijohn, Robt. & Nettie Marcoulier, Paul & Mary Callahan, Frank & Ester Scheer, John & Emilia Deschutes Mobile Park Groc.
