6 WHEREAS, by virtue of the laws of the State of Oregon as set
7 forth and defined in Oregon Revised Statutes, Deschutes County is auth-
8 orized and empowered to acquire by purchase, agreement, donation, or by
9 the exercise of the power of eminent domain, real property or any right
10 or interest therein, including any easement or rights- of- wayfor the
11 widening, straightening, or otherwise changing of any, roads, highways,
12 bridges, approaches, culverts, drains, ditches and for the opening,
13 extending, altering, or straightening of any such road, highway, bridge
14 or approach; and
15 WHEREAS, for purpose of providing a road, which road shall more
16 adequately serve the traveling public, Deschutes County plans and
17 proposes to perform certain work on the section of Studio Road as more
18 specifically set forth in the attached exhibit marked "Exhibit A"; and
19 WHEREAS, for the purposes of locating, relocating, constructing,
20 improving and maintaining said section of highway, to the end that human
21 lives may be saved, property damage minimized, transportation by motor
22 vehicles promoted, highway travel in general safeguarded, and public
23 welfare promoted, it is the judgment of the County Court that the real
24 property hereinafter described is necessary, and that access to and
25 from the said highway should be controlled as specified.
26 NOW THEREFORE, BE IT, AND IT HEREBY IS, RESOLVED by the Deschutes
27 County Court as follows:
28 1. The Deschutes County Court does hereby find and declare
29 that there is needed and required, for the location, relocation, con -
30 struction, improvement, betterment and maintenance of highways of the
31 County road system, certain interests in or fee simple titled to certain
32 parcels of real property, or particular interests therein, needed and

1 required, and the specific use to be made thereof, or which in the best
2 interests of the County and the owner should be acquired, and which is
3 more particularly described in the attached list, marked "Exhibit A ",
4 parcels #1 and #2, under the name of the record owner or reputed owner,
5 and "Exhibit A" is by this reference hereby adopted and made a part
6 hereof as completely and fully as though set forth herein in full.
7 2. That the specified section of highway and the highway
8 facilities for which the said parcel of property, or interest therein,
9 and the same has been planned, designed, located, and will be constructed
10 in a manner which will be most compatible with the greatest public .good
11 and the least private injury or damage.
12 3. That the Deschutes County Court has attempted to agree with
13 the owner of the property described herein as to the compensation for
14 the taking, and that no satisfactory agreement has been reached, therefore,
15 the District Attorney for Deschutes County is directed and authorized to
16 commence and prosecute to final determination such proceedings as may be
17 necessary to acquire title to said parcels of real property, or interest
18 therein.
19 4. That upon the trial of any suit or action instituted to
20 acquire the said real property, or any interest therein, the District
21 Attorney is authorized to make such stipulation, agreement or admission
22
as in his judgment may be for the best interests of Deschutes County.
23 5. That this resolution be entered in full in the minutes and
24 records of the Deschutes County Court this 3rd day of April, 1969.
