An Order Forming the Bend Area
Transportation District, Establishing the
Name and Ordering that a Measure to Form ORDER NO. 2004-067
the District and Authorize a Permanent Rate
Limit for Operating Taxes be Placed on the
November 2, 2004 General Election Ballot
WHEREAS, pursuant to ORS 267.520(1), the Board of County Commissioners of Deschutes
County, Oregon (Board") approved the formation of the Bend Area Transportation District ("District")
on July 12, 2004 in Order No. 2004-040 which is incorporated by reference herein; and,
WHEREAS, the Board of County Commissioners finds that a permanent tax rate limit of $.29
per $1000 assessed value is sufficient to assure adequate revenue to operate the District; and,
WHEREAS, the governing body of the district shall consist of seven members elected at large
for four year terms; and,
WHEREAS, if the District formation and permanent rate limit is approved, the election of the
District Board Members shall be at the election held the third Tuesday of May, 2005; and,
WHEREAS, ORS 198.810 (3)(a) requires an election be held on the question of forming the
District and setting a permanent rate limit and the November 2, 2004, general election is the first
available election; and,
WHEREAS, a Notice of District Measure Election and Explanatory Statement for County
Voters' Pamphlet must be sent to the Deschutes County Clerk no later than August 24, 2004; and,
WHEREAS, ORS 198.815 (1) requires the Board to cause notice of the election to be published
by two insertions in a publication of general circulation in the proposed District; now, therefore.
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. The Bend Area Transportation District is hereby declared to be formed subject to
the approval of the electors in the proposed district in the November 2, 2004 general election.
Section 2. The name of the district shall be the Bend Area Transportation District and the
boundaries shall be as legally described in Exhibit "A" and depicted on the map Exhibit "B," both
exhibits being attached hereto and by this reference incorporated herein.

Section 3. That the proposed Bend Area Transportation District, if formed, will have a permanent
rate limit for operating taxes of $.29 per $1,000 assessed value that will raise an estimated $1,697,277 in
operating funds for the District in the 2005-2006 fiscal year.
Section 4. That the Bend Area Transportation District shall be authorized to take all necessary
and proper steps to plan, establish, furnish and maintain a system for the transportation of passengers
within the Bend area and to construct, maintain and operate any related facilities pursuant to ORS
267.510 et seq.
Section 5. The Bend Area Transportation District governing body shall be elected at an
election held the third Tuesday of May, 2005.
Section 6. In accordance with ORS 198.810 (3)(a), the issue of forming the Bend Area
Transportation District and authorizing the permanent rate limit for operating taxes shall be referred to
the qualified electors of Deschutes County at the November 2, 2004 general election for approval or
rejection.
Section 7. The Deschutes County Clerk is hereby directed to place this matter on the November
2, 2004, general election ballot.
Section 8. No later than August 24, 2004, the Notice of County Measure Election and
Explanatory Statement, in substantially the form set forth in Exhibit "C" and area Map as set forth in
Exhibit "B," attached hereto and by reference incorporated herein, shall be submitted to the
Deschutes County Clerk who shall cause the Map in Exhibit "B" to be included with the ballot for the
election.
Section 9. Published notice of the election shall be given in substantially the form set forth in
Exhibit "D," attached hereto and by this reference incorporated herein. The recording secretary shall
cause the notice to be published in The Bulletin on October 5, 2004 and October 19, 2004.

SUMMARY (175 Words)
This measure may cause property taxes to increase more than three percent.
A transportation district would be established covering the City of Bend and additional territory. The name of the
district would be the Bend Area Transportation District. The purpose of the district would be to plan, establish, furnish
and maintain a system for the transportation of passengers within the Bend area and to construct, maintain and operate
any related facilities pursuant to ORS 267.510 et seq.
If approved, this measure would authorize the district to tax properties within the district for the above listed services at a
maximum permanent tax limit of $.29 per $1000 assessed value. The district taxes would be imposed starting with tax year
2005-2006. If this measure passes, the election of the governing body will be held in May 2005.

The City of Bend ("City') filed a resolution with the Deschutes County Board of County Commissioners
("Board") requesting the initiation of the formation of the Bend Area Transportation District ("District").
The purpose of the District is to plan, establish, furnish and maintain a system for the transportation of
passengers within the Bend area and to construct, maintain and operate any related facilities. As part of
the efforts to provide for the transportation of passengers, the City is developing a Capital Improvements
Program to be presented to the District governing body that includes a fixed-route bus system in addition
to maintaining and enhancing the current Dial-A-Ride service for eligible seniors and disabled persons.
Formation of the District provides eligibility to obtain federal and state matching funds for these
transportation projects.
If the District is approved by the voters, an election will be held in May 2005 to elect the governing body of
the District. The governing body shall consist of seven members elected from the District at large for four-
year terms with the first members having staggered terms.
If approved, the maximum amount that the District could levy each fiscal year would be $.29 per $1,000
assessed value. The District, however, need not levy the full amount of the permanent tax rate in any
given year. The District Governing Body will determine the amount to levy each year based upon the
annual budget approved each year by the District Budget Committee consisting of the District governing
body and seven electors from the District appointed by the District Governing Body. The District Budget
Committee and District meetings will be open to the public. The estimated first year ad valorem tax levy
is $.29 per $1,000 assessed value.

NOTICE OF ELECTION ON FORMATION AND RATE LIMIT
SUNRIVER SERVICE DISTRICT
Pursuant to ORS 198.815 (1), the Board of County Commissioners for Deschutes
County hereby gives notice that on November 02, 2004 an election will be held
within the boundaries of the proposed Bend Area Transportation District on
whether to approve formation of the district and a rate limit of $.29 per $1,000
assessed value for operating taxes. The purpose of the district will be to plan,
establish, furnish and maintain a system for the transport of passengers within the
Bend area and to construct, maintain and operate any related facilities pursuant to
ORS 267.510 et seq. All persons registered to vote within the boundaries of the
proposed district are eligible to vote on this measure.
The proposed district includes territory within the City of Bend, City owned
property North of Cooley Road and East of Hwy 97, and Deschutes River Woods,
including the area between Deschutes River Woods and the City of Bend. The
boundaries of the district will be shown on a map in the voter's pamphlet received
by voters with the boundaries of the proposed district. A map of the proposed
district is also available from the office of the Deschutes County Clerk.
