8-581-Order Recorded 10/30/1963VOL WE 581 IN THE COUNTY COURT OF THE STITE OF OREGON FOR THE COUNTY OF DESCHUTES In the Matter of Permit To Install Pipeline Along ) O R D E R and Across a County Road ) Right-of-way ) This matter coming before the Court upon the petition of Keith Ramsay, asking permission to install a pipeline along and across a County Road, running a distance of 1,088 feet $long Bear Creek Road, starting at East 13th Street and running East and thereupon crossing the Ferguson Road and extending South 515 feet, the Court having made investigation and being advised finds as follows: That is is necessary that Keith Ramsay be, and he is hereby authorized to install an 8 inch pipeline along a County road right-of-way, said road being Bear Creek Road, and across Ferguson County Road, and ex- tending South 515 feet. The permittee shall be responsible for any or all damage to the existing pavement; the shoulder area shall be graded and established to the grade and slope that existed before excavation was begun; haul and place cin- ders on the shoulders as they existed before excavation was begun; any or all pavement cuts shall. be cut on a neat line with a breaking hammer prior to excavation and black filled with dirt with allowance for existing cinder base well compacted prior to patching to the original state, before exca- vation. Deschutes County assumes no responsibility for damages to any per- sons or property as a result of this operation. The project must be properly signed to warn the traffic of any or all hazards to the traveling public. All cleanup and repair of any damages resulting from this operation shall be to the complete satisfaction of the Deschutes County Roadmaster. Al work pertaining to this project shall be completed ina reasonable time, allev- iating all traffic hazards as soon as possible. Deschutes County specifically reserves the right to remove the said pipe if at any time it becomes a menace or a hazard to maintain the road, or to the traffic thereupon.
